The subject of the contract is summer and winter cleaning and maintenance of greenery in municipal areas outside the road right-of-way and in residential green areas for a period of 12 months from the date of conclusion of the contract, divided into lots, with the possibility of exercising options. 2. The subject of the contract is divided into lots: Lot 1: District 1, i.e. Centrum, Śródmieście Północ, Śródmieście Zachód Lot 2: District 2, i.e. Łagiewniki, Rozbark Lot 3: District 3, i.e. Szombierki, Bobrek Lot 4: District 4, i.e. Miechowice, Karb Lot 5: District 5, i.e. Stroszek, Sucha Góra, Stolarzowice, Górniki 3. The complete set of elements covered by the contract in each lot, for both the basic scope and the optional scope, constitutes fulfillment of the obligations related to maintaining cleanliness and order in areas outside the road right-of-way within the administrative boundaries of the city of Bytom, imposed on the Contracting Authority pursuant to Article 5(5) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Journal of Laws of 2024, item 399, as amended). 4. The subject of the contract and the manner of its performance in each lot are specified by: a) Detailed Description of the Subject of the Contract with appendices (hereinafter SOPZ) – Appendix No. 1 to the SWZ b) Estimated quantities – Appendices Nos. 1.1–1.5 to the SWZ c) Draft contractual provisions – Appendix No. 2 to the SWZ. 5. The Contracting Authority permits the submission of partial tenders with respect to the 5 lots of the procedure. 6. A tender may be submitted for 5 lots. 7. The Contracting Authority does not limit the number of lots that may be awarded to one Contractor. 8. The Contracting Authority does not require the submission of a tender in the form of an electronic catalogue. 9. Before commencing the procedure, the Contracting Authority did not conduct preliminary market consultations. 10. The Contracting Authority does not provide for variant tenders. 11. The Contracting Authority permits the possibility of cancelling the procedure if the public funds that it intended to allocate to finance all or part of the contract have not been granted to it. 12. Requirements concerning the submission of a tender by contractors jointly applying for the award of the contract: Pursuant to Article 58 of the Pzp Act, Contractors may apply jointly for the award of the contract (consortia, civil-law partnerships). Where Contractors jointly apply for the award of the contract, the Contractors shall appoint an attorney-in-fact to represent them in the contract award procedure or to represent them in the procedure and conclude the public procurement contract (the above does not apply to a civil-law partnership if the Contractors attach to the tender the partnership agreement from which the authorization to act on behalf of the partnership will arise, or if all partners sign the tender). To the extent not regulated by the SWZ, the provisions of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on entity-specific means of proof and other documents or statements that the Contracting Authority may require from the subcontractor shall apply (Journal of Laws of 2020, item 2415). 13. The Contracting Authority provides for the award of contracts consisting in the repetition of similar services, as referred to in Article 214(1)(7) of the Pzp Act. 16. The Contracting Authority conducts the procedure independently. 17. The notice does not concern a contract for social social and other specific services. 18. The Contracting Authority does not provide for the requirements referred to in Article 94 of the Pzp. 19. The Contracting Authority does not provide for subject-matter means of proof. 20. PROTECTION OF PERSONAL DATA The Contractor declares that it meets the requirements set out in Articles 28, 29, 30, 32 and 33 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, in particular: a) it ensures that it applies technical and organisational measures ensuring the security of the personal data provided, b) it ensures that only authorised persons whom the Contractor has instructed to process personal data have access to the entrusted personal data, c) it ensures that only persons authorised to do so have access to the premises in which the entrusted data are processed and that access to those premises is supervised, d) it ensures that the systems, applications and IT equipment used to process the entrusted data are protected against unauthorised disclosure or loss of the entrusted data, e) it ensures that the remote-access connection to the IT system is secured by an encrypted channel, f) it ensures that it will cooperate with the controller in order to exercise the rights of persons to whom the entrusted personal data relate, as specified in Chapter III of the cited Regulation, g) it ensures that it will immediately inform the controller of a personal data breach and will cooperate with the controller to the extent necessary to fulfil the controller's obligations relating to the personal data breach under the cited Regulation. The Contractor declares that it maintains documentation confirming the performance of the above activities and that, at the controller's request, it will make the indicated documentation available. 1.
