Grounds for exclusion applicable in this procedure for Lots Nos. 1-12: - Article 108(1) of the Public Procurement Law, - Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (consolidated text, Journal of Laws of 2025, item 514), - the prohibition referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine. 4. Entity-specific evidence to be submitted to confirm the absence of grounds for exclusion: 1) Information from the National Criminal Register within the scope specified in Article 108(1), points 1 and 2 of the Act, drawn up no earlier than 6 months before its submission; 2) Information from the National Criminal Register within the scope of Article 108(1), point 4 of the Act, concerning the absence of a final ruling prohibiting participation in public procurement procedures as a penal measure, drawn up no earlier than 6 months before its submission; 3) A declaration by the Contractor, within the scope of Article 108(1), point 5 of the Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection (consolidated text, Journal of Laws of 2025, item 1714), as another Contractor that submitted a separate tender, or a declaration of membership in the same capital group together with documents or information confirming that the tender in the procedure was prepared independently of another Contractor belonging to the same capital group – the template constitutes Annex No. 4 to the SWZ; 4) A declaration by the Contractor confirming that the information contained in the declaration referred to in Article 125(1) of the Act remains current, insofar as it relates to the grounds for exclusion specified in Article 108(1), points 3-6 of the Act – the template constitutes Annex No. 7 to the SWZ, or, in the case of Contractors using a certificate to demonstrate the absence of grounds for exclusion from the procedure pursuant to Article 108(1), points 1-5 of the Act: A declaration by the Contractor confirming that the information contained in the declaration referred to in Article 125(1) of the Act remains current, insofar as it relates to the grounds for exclusion specified in Article 108(1), point 6 of the Act – the template constitutes Annex No. 7a to the SWZ 5) A declaration by the Contractor confirming that the information concerning not being subject to the prohibition referred to in Article 5k(1) of Regulation 833/2014 and not being subject to exclusion from the procedure pursuant to Article 7(1) of the Act on counteracting support for aggression remains current – the template constitutes Annex No. 8 to the SWZ; In the case of Contractors jointly applying for the award of the contract, each Contractor shall separately submit the documents specified in point IX, subpoint 4. 1) – 4. 5) of the SWZ. 5. The Contractor may not invoke granted certification or use a certificate in a contract award procedure if it does not meet the conditions for granting certification, including where the certification has expired or has been suspended. 7. The certificate replaces entity-specific evidence only to the extent covered by valid certification.
