The subject of the contract is Cleaning services at the facilities of the Polish Army Museum. The contract is divided into 4 lots: 1) Cleaning services at the facilities of the Polish Army Museum at the Warsaw Citadel, covering the following facilities: South Pavilion, buildings No. 1, 5, 6, 82, building No. 26 (chapel), and the toilets by the bus parking area 2) Cleaning services at the facilities of the Katyń Museum – Martyrological Branch of the Polish Army Museum 3) Cleaning services at the facilities of the Museum of Armoured Weapons in Poznań – Branch of the Polish Army Museum in Warsaw 4) Cleaning services at the facilities of the Museum of Polish Military Technology – Branch of the Polish Army Museum 1. Contractors with respect to whom any of the circumstances indicated below apply shall be excluded from the contract award procedure: 1) in Article 108(1) of the Act; 2) in Article 109(1)(4) of the Act, i.e. a contractor in respect of whom liquidation has been opened, bankruptcy has been declared, whose assets are being administered by a liquidator or a court, who has entered into an arrangement with creditors, whose business activity has been suspended, or who is in another situation of this kind arising from a similar procedure provided for in the laws of the place where such procedure was initiated. 2. The Contractor shall be excluded in accordance with Article 111 of the Act. 3. In this public procurement procedure, the Contracting Authority also applies the measure referred to in Article 1(3) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2022, item 835, as amended), hereinafter referred to as the “Sanctions Act”. 4. Furthermore, the Contracting Authority shall exclude a Contractor from the procedure in the cases indicated in: 1) Article 5k of Regulation 833/2014, as amended by Regulation (EU) 2022/576 of 9 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No L 111 of 8.4.2022, p. 1), and 2) Article 7(1) of the Sanctions Act. 5. In view of the above, the Contracting Authority shall exclude from this procedure: 1) contractors acting on behalf of or with the participation of: a) Russian nationals or natural or legal persons, entities or bodies established in Russia; b) legal persons, entities or bodies whose ownership rights are directly or indirectly more than 50% owned by an entity referred to in point (a) of this paragraph; or c) natural or legal persons, entities or bodies acting on behalf of or at the direction of an entity referred to in point (a) or (b) of this paragraph, including subcontractors, suppliers or entities whose capacities are relied on within the meaning of the public procurement directives, where they account for more than 10% of the contract value. 2) Contractors: a) listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or entered on the list pursuant to a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the Sanctions Act; b) whose beneficial owner, within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, items 593 and 655), is a person listed in the lists specified in Regulation 765/2006 and Regulation 269/2014, or entered on the list, or who has been such a beneficial owner since 24 February 2022, provided that the person was entered on the list pursuant to a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the Sanctions Act; c) whose parent undertaking, within the meaning of Article 3(1)(37) of the Act of 29 September 1994 on accounting (Journal of Laws of 2021, items 217, 2105 and 2106), is an entity listed in the lists specified in Regulation 765/2006 and Regulation 269/2014, or entered on the list, or which has been such a parent undertaking since 24 February 2022, provided that it was entered on the list pursuant to a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the Sanctions Act. 6. The Contracting Authority shall reject the tender of a Contractor excluded pursuant to Article 5k of Regulation 833/2014 and Article 7(1) of the Sanctions Act. The Contracting Authority requires all persons performing physical activities (cleaning) directly related to the performance of the subject matter of the contract to be employed by the Contractor under an Employment Contract within the meaning of Article 22 § 1 of the Act of 26 June 1974 – Labour Code (consolidated text: Journal of Laws of 2025, item 277, as subsequently amended) throughout the contract performance period.
