Poland – Cleaning services – Provision of cleaning and housekeeping services for the needs of the Świętokrzyskie Voivodeship Office in Kielce

Opportunity description

1. The subject matter of the contract is the provision of cleaning and cleanliness maintenance services and the performance of housekeeping work for the needs of the Świętokrzyskie Voivodeship Office in Kielce in buildings with an area of 15 224,80 m2 located within the city of Kielce. 2. A detailed description of the subject matter of the contract is provided in Appendix No. 1 to the SWZ. 3. Before submitting a tender for the performance of the services covered by this contract, the contracting authority recommends that the contractor conduct a site visit at the place where the subject matter of the contract will be performed in order to determine, at its own responsibility, the possibility of any risks occurring that may affect the contract performance costs necessary for preparing the tender. Failure by the contractor to exercise the right to conduct a site visit may not constitute grounds for making any claims at the contract performance stage if the contractor’s tender is deemed the most advantageous in the procedure in question. The contractor bears the risk of incorrectly assessing the conditions existing at the place where the subject matter of the contract will be performed. 4. The contracting authority provides for the requirements referred to in Art. 95(1) of the Pzp Act and specifies them pursuant to Art. 95(2) of the Pzp Act. 1) The contracting authority requires that, throughout the term of the contract, all persons referred to in paragraph 10 who, in performing the contract, will carry out activities involving cleaning premises, maintaining cleanliness and performing housekeeping work be employed by the contractor or subcontractor under an employment contract. 5. The activities indicated in the description of the subject matter of the contract, constituting the subject matter of the contract, which must be performed by the contractor’s employees or the subcontractor’s employees employed under an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277, as amended), will be performed by persons indicated by the contractor in the List of Persons. 6. During contract performance, the contracting authority is entitled to carry out inspections of the contractor regarding compliance by the contractor or subcontractor with the requirement to employ under an employment contract the persons performing the activities indicated in paragraph 4 point 1. 7. In particular, the contracting authority is entitled to: 1) request declarations and documents confirming compliance with the above-mentioned requirements and assess them; 2) request explanations in the event of doubts concerning confirmation of compliance with the above-mentioned requirements; 3) conduct inspections at the place where the service is performed. 8. During contract performance, at each request of the contracting authority and within the time limit specified in that request, the contractor shall submit to the contracting authority the evidence indicated below to confirm compliance with the requirement that the contractor or subcontractor employ under an employment contract the persons performing the activities indicated in paragraph 4 point 1 during contract performance: 1) A declaration by the contractor or subcontractor concerning the employment under an employment contract of persons performing the activities covered by the contracting authority’s request. This declaration should include in particular: precise identification of the entity submitting the declaration, the date of submission of the declaration, an indication that the activities covered by the request are performed by persons employed under an employment contract, together with the number of such persons, the type of employment contract and working-time equivalent, and the signature of the person authorised to submit the declaration on behalf of the contractor or subcontractor. 9. In the event of justified doubts as to compliance with labour law by the contractor or subcontractor, the contracting authority may request an inspection by the National Labour Inspectorate. “By entering into an employment relationship, an employee undertakes to perform work of a specified type for the employer and under the employer’s direction, and at a place and time designated by the employer, while the employer undertakes to employ the employee for remuneration.” 10. The contracting authority requires the contractor, when performing the contract, to provide at least 18 persons for the proper performance of the cleaning service (at least 8 persons for the morning service and at least 10 persons for the afternoon service). The contractor is obliged to ensure (within the above-mentioned number of 18 persons) the presence of persons performing the duties of shift foreperson, separately for the morning and afternoon services – i.e. 2 persons. 11. The contracting authority requires that 4 persons (2 persons from the morning service and 2 persons from the afternoon service) performing the subject matter of the contract hold authorisation to perform work at heights above 3 m, confirmed by a valid medical certificate stating that there are no contraindications to working at heights. 12. The contracting authority requires the contractor to provide full replacement, in the event of absence from work of employees forming part of the services, with persons who will provide 100% replacement in the event of their absence from work. 13. The contracting authority requires the contractor to use, for the performance of the cleanliness maintenance service and housekeeping work, professional products suited to the type of surface, which do not cause damage, are biodegradable and comply with occupational health and safety requirements.
