The subject of the contract is the construction of flood protection for the town of Jastarnia from the side of Puck Bay – section km 49,20-52,80 under the “design and build” system in accordance with the functional and utility programme for 2 sections: for the eastern and port section at approx. km 49,20-51,40 and the central section at approx. km 51,40-52,80 as part of the project entitled: “Protection of the shores against flooding from the waters of the Gulf of Gdańsk” for the sections: 1). eastern and port at approx. km 49,20-51,40, 2). central at approx. km 51,40 – 52,80 3). western at approx. km 52,80-53,90. 2. The subject of the contract has been divided into two parts: Part 1 - Construction of flood protection for the town of Jastarnia from the side of Puck Bay – Eastern and port section at approx. km 49,20 - 51,40 under the "design and build” formula, Part 2 - Construction of flood protection for the town of Jastarnia from the side of Puck Bay – Central section at approx. km 51,40 – 52,80 under the "design and build" formula.3. The Contracting Authority permits the submission of partial tenders for the individual separate parts. Tenders may be submitted for all parts. 4. The detailed scope of the contract is included in the Functional and Utility Programme (Annex No 4 to the SWZ) 5. The performance conditions have been specified and in the Draft contract for Part 1 (Annex No 5A to the SWZ) and the Draft contract for Part 2 (Annex No 5B to the SWZ). 6.The contract is co-financed by the European Union under the European Funds for Infrastructure, Climate, Environment Programme for 2021-2027 (FEnIKS) for 2021-2027 - “Protection of the shores against flooding from the waters of the Gulf of Gdańsk.7. Pursuant to Art. 95(1) and (2) of the Pzp Act, the Contracting Authority requires that, during performance of the contract, the Contractor or a Subcontractor reported by it continuously employ, on the basis of an employment relationship and at working hours commensurate with the assigned tasks, persons performing the activities specified in §2 para. 29 of the Contract. The detailed method of verifying the employment of the persons referred to in para. 1) has been specified in §2 para. 32 of the Contract. The Contracting Authority’s powers to verify the contractor’s compliance with requirements relating to the employment of persons are specified in §2 paras. 33-36 of the Contract. Sanctions for failure to meet requirements relating to the employment of persons are specified in §22 para. 1 point 9) of the Contract.8.Deadline for performance of the contract in Parts 1 and 2: up to 24 months from the date of signing the contract. 1.
