Opportunity description
1. The subject matter of the contract is: Supply of reinforced-concrete mining lagging for roadway supports for the Branches of Polska Grupa Górnicza S.A. – group No. 288-5. 2. CPV code: 44113330. 3. A detailed description of the subject matter of the contract, as well as the legal requirements and technical and operational parameters, is set out in Annex No. 1 to this SWZ. The quantitative scope of the subject matter of the contract is an estimated scope determined by the Contracting Authority with due diligence. Despite exercising due diligence, due to the nature of its activities, the Contracting Authority does not guarantee that the contract will be performed in full. 4. In order to confirm that the offered supply complies with the Contracting Authority’s requirements, subject-matter evidence must be submitted with the tender. 5. The Contracting Authority does not permit the submission of variant tenders. 6. The Contracting Authority permits more than one product (products from different manufacturers) to be offered for a single item in the tender form. If the contractor offers more than one product (products from different manufacturers) for a given item in the tender form, the following are required: a) each offered product must meet the requirements specified in the SWZ, b) subject-matter evidence concerning all offered products must be submitted. A tender in which products from different manufacturers are offered under a single item in the tender form is deemed compliant with the requirements of the SWZ provided that all products offered for the given item in the tender form meet the requirements. If even one of the offered products does not meet the requirements, the tender shall be rejected pursuant to Article 226(1)(5) of the Pzp Act. 7. The Contracting Authority reserves the right to change the quantities of goods ordered within individual assortment items and to place orders according to actual needs, provided that the total value of the supplies does not exceed the contract value. 8. The Contracting Authority declares that the minimum guaranteed level of contract performance is 50% of the value of the awarded contract. The Contractor shall not be entitled to claim performance of the contract to a greater extent. 9. The procedure for the award of a sectoral contract is conducted as an open procedure pursuant to the provisions of the Act of 11 September 2019, Public Procurement Law (Journal of Laws, item 2019, as amended), hereinafter referred to as the Pzp Act. 10. The procedure is conducted in Polish. 11. The information obligation arising from Articles 13 and 14 of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L.2016.119.1 of 4 May 2016) (hereinafter referred to as “RODO”) has been fulfilled on the PGG S.A. website under the RODO tab, in the attachment “Contractors/Contractors’ Employees”. In the case of personal data processing for a purpose related to the public procurement procedure, the Contracting Authority has fulfilled the information obligation in the Buyer Profile on the Polska Grupa Górnicza website under the “PZP Information Obligation” tab. 12. In addition, the Contracting Authority informs that a) the exercise by the data subject of the right to rectification or completion referred to in Article 16 of RODO may not result in a change to the outcome of the procurement procedure or a change to the provisions of the public procurement contract to an extent inconsistent with the Act. b) in the procurement procedure, the submission of a request for restriction of processing referred to in Article 18(1) of RODO does not restrict the processing of personal data until the procedure has been completed. 13. The Contracting Authority permits the submission of partial tenders for individual parts of the contract (tasks) specified in Annex No. 2 to the SWZ.
