Opportunity description

1. The subject matter of the contract is the supply, in the form of an operating lease, of a compactor for compacting waste with a blade. The subject matter of the contract is the supply of a compactor intended for compacting waste with a blade. The machine must have been manufactured no earlier than in 2004 and completely rebuilt no earlier than in 2026. The machine offered may not be a prototype. 2. A detailed description of the subject matter of the contract is provided in Annex No. 1 to this SWZ. Failure to meet the minimum requirements will result in rejection of the tender as non-compliant with the procurement conditions pursuant to Article 226(1)(5) of the Pzp Act. 3. The financing parameters in the form of an operating lease have been specified in the Material provisions of the agreement, which constitute Annex No. 3 to the SWZ. The Contracting Authority requires the content of Annex No. 3 to constitute an integral annex to the lease agreement. 1. Information on the obligation for the contractor/contractors jointly applying for the award of the contract to personally perform key tasks—Articles 60 and 121 of the Pzp Act. The Contracting Authority does not require the personal performance of key parts of the contract. 4. When specifying requirements concerning standards, the Contracting Authority indicates this as a requirement to comply with those standards or equivalent standards. 5. The financing parameters in the form of an operating lease have been specified in the Material provisions of the agreement, which constitute Annex No. 3 to the SWZ. The Contracting Authority requires the content of Annex No. 3 to constitute an integral annex to the lease agreement. 6. Together with the machine, the Contractor is obliged to provide the Contracting Authority with: a) an operating manual, b) a warranty booklet, c) complete technical documentation, including an extract from the type-approval certificate, d) complete documentation concerning operation of the machine. 7) In addition: a) The Contractor must indicate the authorized warranty service center entitled to carry out warranty and post-warranty repairs of the machine in Poland that is located closest to the Contracting Authority’s registered office. b) The minimum warranty period for the complete machine is 24 months or 2000 mth—whichever occurs first. c) The period of all warranties begins on the date the complete machine is delivered to the Contracting Authority’s registered office. d) The Contractor is obliged to provide instruction in machine operation for a total duration of 7h, including 4h at the Contracting Authority’s registered office (theoretical/demonstration instruction) and 3h in the field (practical/demonstration instruction), dedicated to at least 2 persons, i.e. designated employees of the Contracting Authority. The time allocated to these activities may not impose any costs on the Contracting Authority. During the instruction, several activities related to the machine operator’s occupational health and safety and instructions on how the operator should respond to machine failures should be carried out, so that the Contractor for the subject matter of the contract does not in the future, i.e. under the warranty and statutory warranty, allege improper use of the machine. The instruction should be conducted on the day the machine is accepted. Confirmation that the instruction has been conducted should be included in the machine acceptance report. e) The Contractor is responsible for the quality of the subject matter of the contract and its compliance with the technical and quality conditions described for the subject matter of the contract. f) The Contracting Authority reserves the right to install GPS system devices or another system monitoring the machine’s operation in the machine without voiding the manufacturer’s warranty. g) The machine offered must come from series production. 8) The Contracting Authority shall not be liable for damage caused by the Contractor during performance of the subject matter of the contract. 9) The Contractor shall bear the costs of delivering the machine to the Contracting Authority’s registered office, in particular the costs of transporting, unloading and commissioning the machine.
