Supply of computer equipment, specialized software, multimedia devices and peripherals for equipping school laboratories at the E. Kwiatkowski School Complex No. 1 in Myszków, ul. Kwiatkowskiego 18, 42-300 Myszków as part of the implementation of the project entitled: "Improving the quality of vocational education at the School Complex No. 1 in Myszków"—under the programme: European Funds for Silesia 2021-2027, Measure 08.03. Vocational education infrastructure – ZIT (call No. FESL.08.03 – IZ.01-085/23) (case reference: ZP.272.1.7.2026) 1.1. The subject matter of the contract is the purchase of portable computers—laptops, an interactive monitor, an interactive whiteboard with a projector, software—an office application suite, a 3D printer, multifunction devices, a barcode printer, a mobile terminal (data terminal), a scanner, a portable projector, a projection screen, a dye-sublimation printer, wireless headphones with a microphone, headphones with a microphone, and soundproof headphones supporting students’ sensory regulation. A detailed description of the subject matter of the contract is set out in Appendix No. 1 to the SWZ—Technical Specification and Appendix No. 3 to the SWZ—Draft Contractual Provisions. The scope of the subject matter of the contract also includes the service of connecting and initially commissioning the equipment. 1.2. The subject matter of the contract is implemented as part of an EU project. All supplied devices must meet accessibility standards for persons with special needs at a minimum basic level, in accordance with the Accessible School Model (MDS) document. The Contractor shall ensure that the supplied equipment is brand-new, complete and operational, is free from physical and legal defects, and has been placed on the market in accordance with the legal acts implementing the New Approach Directives, as confirmed by the CE marking, in accordance with the Act of 30 August 2002 on the conformity assessment system (consolidated text, Journal of Laws of 2023, item 215, as amended) and the Regulation of the Minister of Development of 2 June 2016 on requirements for electrical equipment (Journal of Laws of 2016, item 806). 1.4. The Contractor shall ensure that the supplied software: - comes from a legal source and has all components confirming the legality of its origin (e.g. original packaging, original medium, licence agreement, access key, etc.), - does not infringe the Act on Copyright and Related Rights (i.e. Journal of Laws of 2025, item 24, as amended), - comes from the manufacturer’s official sales and distribution channels for the Polish market. 2. GUARANTEE AND STATUTORY WARRANTY The required minimum guarantee period for the equipment is 24 months. The guarantee period constitutes a tender evaluation criterion described in detail in Chapter XI of the SWZ. 3. EQUIVALENT SOLUTIONS 4. If, in the description of the subject matter of the contract, the Contracting Authority has indicated trademarks, patents or origin, sources or a specific process that characterizes the products or services supplied by a particular Contractor, solutions equivalent to those described may be offered, provided that they maintain the same minimum technical, quality and functional parameters, etc. 5. A Contractor relying on equivalent solutions is obliged to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 6. Where the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and Article 101(3) of the Pzp Act, the Contracting Authority permits solutions equivalent to those described.
