Opportunity description

The public procurement procedure is conducted as an open tender, pursuant to Eng. 132 of the Act of 11 September 2019, Public Procurement Law (Journal of Laws of 2024, item 1320), hereinafter referred to as the “PPL Act”, the implementing regulations issued pursuant thereto, and the Civil Code. In matters not regulated by these SWZ, the provisions of the PPL Act shall apply. 2. The Contracting Authority, in accordance with Art. 139 of the PPL Act, provides for the reverse order of activities, i.e. it may first examine and evaluate the tenders and then carry out the qualification of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion.The Contracting Authority shall exclude Contractors who are subject to exclusion based on the grounds referred to in Art. 108(1) of the PPL Act and Art. 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2025, item 514), as well as Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 229, 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 111, 8.4.2022, p. 1). 7. Where Contractors jointly apply for the award of the contract, the Contracting Authority shall examine whether grounds for exclusion exist in respect of each of these Contractors. 8. If a Contractor intends to entrust the performance of part of the contract to a Subcontractor, the Contracting Authority shall examine whether the grounds for exclusion provided for in respect of the Contractor exist in respect of that Subcontractor. 9. Before selecting the most advantageous tender, the Contracting Authority shall call upon the Contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days, the following entity-specific evidence valid as at the date of submission:1)absence of grounds for exclusion: a)information from the National Criminal Register within the scope of Art. 108(1)(1), (2) and (4) of the PPL Act, prepared no earlier than 6 months before its submission; b)a statement by the Contractor, within the scope of Art. 108(1)(5) of the PPL Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection, as another Contractor that submitted a separate tender, or a statement of membership in the same capital group together with documents or information confirming that the tender was prepared independently of another Contractor belonging to the same capital group; the statement must be prepared using a form whose content complies with Appendix No 5 to the SWZ; c)a statement concerning the currency of the information contained in the JEDZ form, prepared using a form whose content complies with Appendix No 8 to the SWZ.
