1. The subject of the contract is the successive delivery to the contracting authority’s premises of computer equipment and computer accessories (hereinafter also referred to as the “assortment”), in accordance with the contracting authority’s requirements specified in the Detailed requirements concerning the subject of the contract. 2. The Detailed requirements concerning the subject of the contract constitute an integral part of the description of the subject of the contract and are contained in Part IV of the SWZ. 3. The contractor is obliged to provide the contracting authority with a quality guarantee under the terms of the manufacturer’s warranty. The warranty requirements are specified in Part III. 4. The warranty period for the subject of the contract covered by a given requisition will be calculated from the date on which the delivery and acceptance protocol for the subject of the contract under that requisition is drawn up. 5. The delivered subject of the contract must be brand new, not displayed at exhibitions, complete, and technically operational. The term “brand new” shall mean a subject of the contract that is originally packaged and unused before the date of delivery, excluding use necessary to test its proper operation after manufacture. 6. The subject of the contract must be free from any physical and legal defects and third-party claims. 7. The delivered subject of the contract must originate from the manufacturer’s distribution channel that does not exclude distribution to the Polish market and ensures the exercise of warranty rights. 8. The subject of the contract must be delivered together with operating instructions, drivers, and any accompanying software necessary for the proper use of the subject of the contract (to obtain the full functionality indicated in Part IV of the SWZ). The contracting authority will not be obliged to pay any additional charges, in particular licence fees, and any licences will be granted as part of the contractor’s remuneration, without time or territorial limitations, unless expressly stated otherwise in Part IV of the SWZ. If licences, codes, or other authorisations are required to launch and use this software, they must be supplied at no additional charge. Codes, licences, and other authorisations must also be supplied when they are necessary to launch or configure hardware components. 9. The delivered subject of the contract intended to be powered from the electricity grid must be equipped with an appropriate number of power cables allowing it to be connected to standard power sockets—unless stated otherwise in Part IV of the SWZ. 10. On the date the tender is prepared, the offered subject of the contract must not be scheduled by the manufacturer for withdrawal from production or sale. 11. The contracting authority requires that the offered subject of the contract comprising ICT products, ICT services, and ICT processes used to perform the contract shall not include: • ICT products, ICT services, or ICT processes indicated in the recommendation referred to in Art. 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have an adverse impact on the fundamental interest of state security; • an ICT product whose type has been specified in the decision on recognising a supplier as a high-risk supplier referred to in Art. 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirements will result in the rejection of the tender, as applicable, pursuant to Art. 226(1)(17) or (19) of the Pzp Act. 12. Whenever this SWZ refers to an ICT solution, ICT element, ICT product, ICT service, or ICT process, this shall mean an ICT product, ICT service, or ICT process referred to in the Act of 5 July 2018 on the National Cybersecurity System (hereinafter also the KSC Act). 13. Since the subject of the contract consists of hardware components and the associated firmware and system software, both the main elements and the components, service delivery environment elements, or accompanying solutions will therefore be subject to verification against the requirements referred to in point I.3.11 of the SWZ.
