Opportunity description
1. The subject matter of the contract is the sale and delivery of brand-new, unused equipment/assortment/devices together with software as part of the modernization of the Main Server Room of the University of Rzeszów. The subject matter of the contract has not been divided into lots. The Contracting Authority does not allow the submission of tenders for individual lots. Reasons for not dividing the contract into lots. The subject matter of the contract constitutes a functional whole; dividing the contract into lots could result in excessive technical difficulties and excessive contract performance costs. Furthermore, the absence of division is justified by organizational considerations; a possible division of the contract could seriously jeopardize its proper performance, and the need to coordinate the activities of different contractors performing individual lots could jeopardize the proper and timely performance of the contract. Furthermore, the failure to divide the contract into lots does not infringe competition by limiting the possibility of applying for it. 2. A detailed description and the method of contract performance are contained in the Description of the Subject Matter of the Contract (OPZ), constituting Appendix No. 3 to the SWZ. 3. Contractors may apply for the award of the contract if they meet the conditions concerning: 1) capacity to conduct business transactions: The Contracting Authority does not impose any condition in the above respect. 2) authorization to conduct specific business or professional activities, where required under separate regulations: The Contracting Authority does not impose any condition in the above respect. 3) economic or financial standing: The Contracting Authority does not impose any condition in the above respect. 4) technical or professional capacity: The Contracting Authority imposes a condition regarding technical or professional capacity. The Contractor will meet the condition if it demonstrates that, during the last 3 (three) years before the deadline for submission of tenders, or, if the period of business activity is shorter, during that period, it duly completed at least one single delivery comprising the delivery of servers, arrays and network switches to one entity for a total gross amount of at least PLN 1,100,000.00, or duly completed at least three separate deliveries, including one delivery comprising the delivery of servers for a total gross amount of at least PLN 500,000.00, a second delivery comprising the delivery of arrays for a total gross amount of at least PLN 300,000.00, and a third delivery comprising the delivery of network switches for a total gross amount of at least PLN 300,000.00. The Contractor shall attach evidence showing whether the listed deliveries were duly performed. The Contracting Authority will assess compliance with these conditions on the basis of the submitted documents, evidence and declarations using the 0–1 method as follows: meets/does not meet. Values stated in foreign currencies in documents submitted by Contractors to demonstrate compliance with the conditions for participation in this procedure will be converted by the Contracting Authority according to the average NBP exchange rate on the date of publication of the contract notice in the BZP. 4. The Contracting Authority intends to apply the so-called reverse procedure referred to in Article 139(1) of the PZP Act. 5. Pursuant to Article 257 of the PZP, the Contracting Authority provides for the possibility of cancelling this procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 6. The Contracting Authority does not require the submission of a bid bond. 7. The Contracting Authority does not require a performance bond. 8. A detailed description and the method of contract performance are contained in the description of the subject matter of the contract (OPZ), constituting Appendix No. 3 to the SWZ: a) The proposed equipment/assortment/devices must be new, unused and free from defects, and their technical and functional parameters must be no lower than those presented in the description of the subject matter of the contract constituting Appendix No. 3 to the SWZ. b) The proposed software must be free from defects, and its technical and functional parameters must be no lower than those presented in the detailed description of the subject matter of the contract constituting Appendix No. 3 to the SWZ. c) The Contracting Authority allows the submission of equivalent tenders. Wherever the Contracting Authority describes the subject matter of the contract by indicating trademarks, patents or references to standards, European technical assessments, approvals, origin, technical specifications and/or technical reference systems, the Contracting Authority allows solutions equivalent to those described.
