I. Subject matter of the contract: 1. The subject matter of the contract is: Successive purchase and delivery of laptops (portable computers) together with additional accessories for various organizational units of the University of Opole. 2. The description of the subject matter of the contract constitutes Annex No. 1A to the SWZ. II. Other information: 1. The Contracting Authority does not allow the submission of tenders for separate lots. 2. The Contracting Authority does not allow the submission of variant tenders. 3. The Contracting Authority does not require employment on the basis of an employment relationship in the circumstances referred to in Article 95 of the Act. 4. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(7) and (8) of the Public Procurement Law. 5. The Contracting Authority does not require a bid bond. 6. The Contracting Authority does not require a performance bond. 1. The subject matter of the contract is: Successive purchase and delivery of laptops (portable computers) together with additional accessories for various organizational units of the University of Opole. 2. The description of the subject matter of the contract constitutes Annex No. 1A to the SWZ. 3. The subject matter of the contract is the successive delivery, including carrying in, of each successive order, with the parameters specified in the description of the subject matter of the contract/agreement (Annex No. 1A to the SWZ), during the period indicated in point 4.1 of the SWZ and within the time limit specified by the Contractor in the tender (in connection with point 4.2 of the SWZ). 4. The subject matter of the contract will be delivered to the Contracting Authority at the Contractor’s risk and as part of the remuneration (specified in the tender) due to the Contractor. 5. The quantities of individual devices covered by the subject matter of the contract indicated in the description of the subject matter of the contract/agreement (Annex No. 1A to the SWZ) are indicative quantities, estimated on the basis of anticipated individual orders. 6. During the performance of the agreement, the Contracting Authority may order a larger or smaller number of individual devices than indicated in the OPZ while maintaining the unchanged unit price of the devices, or may refrain from purchasing a given item. 7. The Contracting Authority will purchase devices covered by the subject matter of this agreement for a value of no less than fifty percent (50%) of the gross remuneration value referred to in § 4(1) of the agreement. 8. The purchase of devices whose minimum parameters are specified in the description of the subject matter of the contract/agreement will take place in response to individual unit orders submitted successively to the Contractor by the Contracting Authority via e-mail during the period referred to in point 4.1. of the SWZ. 9. An individual order is an order prepared successively by the Contracting Authority indicating a device/assortment selected from the description of the subject matter of the agreement, together with the quantity and value of the order, containing a unique order number assigned by the Contracting Authority and information concerning the place of delivery. The individual order is submitted to the Contractor by the Contracting Authority via e-mail. 10. In the Tender Form – Annex No. 1 to the SWZ, the Contractor is required to indicate the manufacturer’s name, product name / model / type or other designation, e.g. P/N (depending on the requirements specified in the Tender Form), unequivocally identifying the offered subject matter of the contract. The Contractor is required to provide data defining the offered subject matter of the contract in a manner enabling the Contracting Authority to unequivocally identify the subject matter of the contract offered by the Contractor against the requirements indicated in the procurement documentation. If necessary for the unequivocal identification of the offered subject matter of the contract, additional information must be provided; the Contractor is required to provide it so that the parties to the procedure have no doubt as to what subject matter of the contract the Contractor is offering. If the Contractor offers independently configured equipment for which there is no manufacturer’s name, product name / model / type unequivocally identifying the subject matter of the contract, and whose parameters the Contracting Authority also cannot verify in publicly available sources, the Contractor is required to unequivocally indicate in the tender the technical data of the offered equipment corresponding to the requirements specified by the Contracting Authority in the description of the subject matter of the contract by attaching a detailed technical specification of the offered equipment. The absence from the tender of information enabling unequivocal identification of the offered product will be deemed by the Contracting Authority to constitute non-compliance of the tender with the content of the SWZ, and the Contracting Authority will reject the tender pursuant to Article 226(1)(5) of the Act. 11. The Contractor must offer performance of the full subject matter of the contract in accordance with the Contracting Authority’s requirements specified in the SWZ and the annexes and must include the entire scope of the subject matter of the contract in the tender. The subject matter of the agreement must comply with the applicable standards and possess the required authorizations for placement on the market and certificates (including, with regard to safety, compliance with the applicable requirements of European Union law and possession of the required CE marking).
