(Numbering in accordance with the SWZ) 4.1 The subject matter of the contract is the routine maintenance and improvement of the quality of public and internal roads with unimproved surfaces and the maintenance of ditches and road shoulders located within the city of Łódź in 2026-2027 – divided into 4 Parts. The task consists of carrying out repairs to unpaved roads and maintenance work on ditches and shoulders located within the road lanes of public roads situated within the city of Łódź, divided into 4 parts (districts), and internal roads managed by the City of Łódź. The work will include routine maintenance, including the repair of damaged surfaces and improvement of the overall condition of unpaved roads in the city. 4.2 A detailed description of the subject matter of the contract is contained in the description of the subject matter of the contract (Appendix No. 1 to the SWZ), the Technical Specifications for the Execution and Acceptance of Construction Works, and on the basis of the concluded contract (draft contract - Appendix No. 12 to the SWZ). 4.3 Pursuant to Art. 95 of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, under an employment relationship, persons performing the activities specified by the Contracting Authority in connection with the performance of the contract, if the performance of these activities consists of carrying out work in the manner specified in Art. 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277), i.e. a) grader operator; b) pneumatic-tyred roller operator; c) steel roller operator, d) backhoe loader operator e) tipper truck driver f) road repair machine operator The above applies to parts No. 1,2,3,4 of the contract 4.4 The type of activities related to the performance of the contract, the method for verifying the employment of these persons, the Contracting Authority’s rights to inspect the Contractor’s compliance with the requirements related to the employment of these persons, and the penalties for failure to meet them have been specified in the description of the subject matter of the contract (Appendix No. 1 to the SWZ) and in the draft contract (Appendix No. 12 to the SWZ). 4.7 The contract has been divided into parts: Part I – area of the Łódź – Bałuty district Part II – area of the Łódź - Górna district Part III – area of the Łódź - Polesie district Part IV – area of the Łódź - Widzew district The Contractor may submit one tender in this procedure for a maximum of one part of the contract. 8.4 Information concerning reliance on the resources of an entity making resources available 8.5 In order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and with regard to a specific contract, or a part thereof, the Contractor may rely on the technical or professional capabilities or the financial or economic standing of entities making resources available, irrespective of the legal nature of the legal relationships between it and them. 8.6 A Contractor relying on the capabilities or standing of other entities making resources available shall submit, together with the tender, the commitment of the entity making resources available to place the necessary resources at its disposal for the purpose of performing the contract concerned, or another entity-specific means of evidence confirming that, when performing the contract, the Contractor will have at its disposal the necessary resources of those entities. cont. in points 8.6.1 - 8.14 of the SWZ. INFORMATION ON THE ANTICIPATED CONTRACTS REFERRED TO IN ART. 214(1), POINTS 7 AND 8 OF THE PZP ACT, IF THE CONTRACTING AUTHORITY ANTICIPATES AWARDING SUCH CONTRACTS Within a period of 3 years from the date of awarding the main contract, the Contracting Authority anticipates the possibility of awarding contracts referred to in Art. 214(1), point 7 of the Pzp Act, i.e. repetition of the construction works contract will consist of carrying out identical works, up to a maximum value of 100 % of the main contract for each part of the contract. The implementation and value of the repeated contract for each part depend on obtaining funds for this purpose. 23. REQUIREMENTS CONCERNING THE TENDER SECURITY, IF THE CONTRACTING AUTHORITY REQUIRES A TENDER SECURITY TO BE LODGED 23.1 The Contracting Authority requires the Contractor to lodge a tender security: - For Part I (area of the Łódź – Bałuty district) – in the amount of 70 000,00 PLN (in words: seventy thousand zlotys 00/100). - For Part II (area of the Łódź - Górna district) – in the amount of 64 000,00 PLN (in words: sixty-four thousand zlotys 00/100). - For Part III (area of the Łódź - Polesie district) – in the amount of 64 000,00 PLN (in words: sixty-four thousand zlotys 00/100). - For Part IV (area of the Łódź – Widzew district) – in the amount of 68 000,00 PLN (in words: sixty-eight thousand zlotys 00/100). cont. provisions in the SWZ.
