Opportunity description

4.4. The subject matter of the contract is the performance of design work, obtaining permits, and carrying out construction works involving the construction of an indoor swimming pool together with site development for the investment project entitled “Construction of an indoor swimming pool in Łuków”, in accordance with the Description of the Subject Matter of the Contract, constituting Appendix No. 1 to the SWZ, and the Draft Contractual Provisions, constituting Appendix No. 2 to the SWZ. 4.5. Whenever trademarks, patents or origin, sources or specific processes, as well as standards, technical assessments, technical specifications, and technical reference systems are used in the SWZ, including in the Description of the Subject Matter of the Contract, the Contracting Authority permits a solution equivalent to the one described. An equivalent product for the specified subject matter of the contract shall mean a product with the minimum parameters and requirements detailed (listed) and defined in detail in the description of the subject matter of the contract contained in Appendix No. 1 to the SWZ. The Contracting Authority permits the submission of equivalent tenders, and all goods specified in the documentation as originating from specific manufacturers define the minimum quality parameters and functional characteristics that the goods must meet in order to satisfy the requirements set by the Contracting Authority and constitute solely a quality benchmark for the subject matter of the contract. By the provision concerning minimum quality parameter requirements, the Contracting Authority means the requirements for goods contained in generally available sources, catalogs, and manufacturers’ websites. The use of example manufacturers’ names is intended solely to clarify the level of the Contracting Authority’s expectations with respect to a particular solution. When describing the subject matter of the contract, where the Contracting Authority indicates the designation of a specific manufacturer (supplier) or a specific product, it simultaneously permits equivalent products with quality parameters and functional characteristics at least at the level of the parameters of the indicated product, thereby accepting any product with the indicated parameters or better. The use of manufacturers’/products’ names is solely illustrative. An equivalent quality standard shall mean one that confirms that the products supplied comply with specified standards or technical specifications, or certifies the compliance of the Contractor’s activities with quality standards, or certifies the compliance of the Contractor’s activities with equivalent quality standards referring to quality assurance systems based on the relevant European standards, or confirms, as appropriate, the Contractor’s application of equivalent quality assurance measures. An equivalent quality standard shall mean one that confirms that the products supplied comply with specified standards or technical specifications, or certifies that the Contractor meets specified quality management standards, including accessibility for persons with disabilities, or certifies that the Contractor meets specified equivalent quality management standards, including accessibility for persons with disabilities, referring to quality management systems based on the relevant series of European standards and certified by accredited bodies.
