The subject matter of the Contract (the Guaranteed Scope understood as the entirety of activities necessary for the comprehensive construction, equipping, performance of technological start-ups and leak tests, and commissioning of the Aquapark in accordance with the Design (excluding elements indicated as the Optional Scope), including in particular general construction, installation and technological works, land development, and obtaining the final occupancy permit for the Investment) is: a) performance of Construction Works consisting in the construction of a water recreation facility (AQUAPARK) with accompanying infrastructure and the construction of outdoor swimming pools supplementing the AQUAPARK offering in Opole; b) achievement of the Control Parameters and performance of the Contractor’s other obligations specified in the SWZ (including in the Contract); whereby the detailed scope of the Subject Matter of the Contract has been described in the procurement documents (the SWZ together with all attachments, including the Procedure Documentation) and must be performed in accordance with the information provided therein and with the provisions of the Contract and all attachments to the aforementioned documents. 3.2. The Subject Matter of the Contract covers the entire investment process, including the performance of Construction Works, delivery and installation of all machinery, equipment and installations together with their commissioning (performance of mechanical and technological start-ups), achievement of the relevant Control Parameters and training of the Aquapark’s operating personnel, as well as submission of acceptance documentation, including as-built documentation and the relevant instructions, acceptance of the Construction Works, and obtaining the final occupancy permit decision. 3.3. The Contractor shall provide comprehensive training to the personnel designated by the Contracting Authority before notifying readiness for final acceptance. The training shall cover at least the operation of swimming pool technology, water treatment systems, HVAC, BMS, safety systems, fire protection systems, alarm systems, access control, ticketing systems, and emergency procedures. Training records constitute acceptance documents. 3.4. The above description presents only the general scope.
