(Numbering in accordance with the SWZ) 4.1. The subject of the contract is the modernization of street surfaces in the City of Łódź, divided into III parts. The scope of the planned works includes: milling of surfaces, construction of new structural layers and bituminous layers, renovation of sidewalks, pedestrian and bicycle routes and stop platforms, construction of bus stop bays and accompanying infrastructure, vertical and horizontal road markings. Planting trees and establishing green areas. 4.1.1. Part I task 1.1 – Modernization of Popioły St. on the section from Rudzka St. to the driveway to the hospital, property no. 4. task 1.2 – Modernization of Ruchliwa St. on the section from Kolejowa St. to Łukowa St. task 1.3 – Modernization of Kolejowa St. on the section from Pabianicka St. to Ruchliwa St. 4.1.2. Part II task 2.1 – Modernization of Irysowa St. on the section from Inflancka St. to Warszawska St. task 2.2 – Modernization of Krótka St. on the section from Zgierska St. to Zachodnia St. task 2.3 – Modernization of Mokra St. on the section from Lutomierska St. to Szamotulska St. task 2.4 – Modernization of Złotnicza St. on the section from Obrońców Warszawy St. to Tokarzewskiego St. 4.1.3. Part III task 3.1 – Modernization of Północna St. on the section from Kilińskiego St. to Wierzbowa St., divided into two stages of works. task 3.2 – Modernization of the pedestrian and bicycle route on Al. Unii on the section from Konstantynowska St. to the pedestrian crossing at the level of the Łódź Kaliska railway station. 4.2. The contract has been divided into parts. The Contracting Authority permits the Contractor to submit a tender for one selected part of the contract. 4.3. A detailed description of the subject of the contract is provided in Appendix no. 1 to the SWZ and in the model contract constituting Appendix no. 7 to the SWZ (one model for all parts of the procedure). Ignacego Skorupki 21, 90-532 Łódź tel.: +48 (42) 638-48-88 e-mail: zamowienia@uml.lodz.pl 33.1 Pursuant to Art. 95 sec. 1 of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ (for each part separately), on the basis of an employment relationship, persons performing the activities specified by the Contracting Authority in connection with the performance of the contract, if the performance of those activities consists in performing work in the manner specified in Art. 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277), i.e. persons performing work during the performance of the contract involving: driving or operating road equipment. 33.2 The Contracting Authority has the right to require the Contractor to present a photocopy of the current employment contract. The photocopy of the contract should contain the employee's first and last name, the date the contract was concluded, the type of employment contract, the working-time basis, and the scope of the employee's duties. 33.3 The type of activities related to the performance of the contract, the method of verifying the employment of these persons, the Contracting Authority's powers to inspect the Contractor's compliance with the requirements related to the employment of these persons, and the sanctions for failure to comply with them are specified in the description of the subject of the contract (Appendix no. 1 to the SWZ) and in the model contract (Appendix no. 7to the SWZ. 27. INFORMATION ON THE ANTICIPATED CONTRACTS REFERRED TO IN ART. 214 SEC. 1 POINTS 7 AND 8 OF THE PZP ACT, IF THE CONTRACTING AUTHORITY ANTICIPATES AWARDING SUCH CONTRACTS Within 3 years from the date of awarding the basic contract, the Contracting Authority anticipates the possibility of awarding contracts referred to in Art. 214 sec. 1 point 7 of the Pzp Act (the possibility of awarding a contract consisting in the repetition of similar services) on selected roads of a similar nature located in the City of Łódź and administered by the Roads and Transport Authority.  Part I – up to a net value of PLN 5 501 464,00 plus applicable VAT  Part II – up to a net value of PLN 5 980 416,00 plus applicable VAT  Part III – up to a net value of PLN 8 368 008,00 plus applicable VAT Contracts within the above-mentioned scope will be awarded on the basis of negotiations with the existing Contractor, under the terms specified in the basic contract. 24.1. The Contractor whose tender has been selected is required to provide a performance bond amounting to 5% of the total gross price stated in the tender for the given part of the contract. 16.7. Pursuant to Art. 257 of the Pzp Act, the Contracting Authority does not anticipate cancelling this procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. 4.1.
