Opportunity description
The subject matter of the contract is the reconstruction of the Collegium Iuridicum building with the UAM Paramuseum space in the basement. A detailed description of the subject matter of the contract is provided in the design documentation, STWiOR, bills of quantities, and the description of the subject matter of the contract [Attachments No. 10]. The Contracting Authority does not allow the submission of partial tenders. Minimum warranty periods: 1) for construction works and installed materials and equipment, the Contractor shall provide a warranty for a minimum period of 36 months from the date on which the Parties sign the final acceptance protocol; Note: The quality warranty period for the completed construction works and installed materials and equipment constitutes a tender evaluation criterion. 2) the statutory warranty for physical and legal defects in materials, equipment, furnishings and all work and construction works performed as part of the performance of the subject matter of the contract shall be provided for a period of 5 years from the date of signing the final acceptance protocol. Pursuant to Art. 95 of the Pzp Act, the Contracting Authority requires the contractor, subcontractor or further subcontractor to employ, under an employment relationship, persons performing work covered by the subject matter of the contract, in accordance with the draft contractual provisions constituting an attachment to the SWZ – this applies to persons performing: construction trade works and installation works covered by the scope of the contract. This requirement does not apply to activities covered by the subject matter of this contract that fall within the duties of persons performing functions in accordance with Chapter 7 point 7.2(a) I of the SWZ: construction managers and works managers. The Contractor may entrust the performance of part of the contract to subcontractors. The Contracting Authority permits equivalent solutions described in the SWZ – in accordance with the provisions of Chapter 4 point 1 of the SWZ. The Contracting Authority stipulates that any proprietary names of materials (products) given in the SWZ or another document forming an integral part of the SWZ are not intended to infringe Art. 99 of the Pzp Act, but are intended solely to specify the Contracting Authority’s quality and technological expectations. This shall be understood as specifying the required minimum performance, functional and technical parameters or quality standards. In accordance with Art. 101(4) of the Public Procurement Law, where the description of the subject matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1 point 2 and paragraph 3 of the Public Procurement Law, and such references are accompanied by the expression “or equivalent”, the Contracting Authority permits an equivalent solution described in each such standard, technical assessment, technical specification and technical reference system. An equivalent solution shall be understood as solutions that guarantee the proper performance of the works and ensure the achievement of technical parameters no worse than those assumed in the procurement documents, do not lower the standards specified in the documentation, ensure performance of the contract in accordance with the Contracting Authority’s expectations and requirements specified in the SWZ, and are characterised by parameters/descriptions no worse than those required and contained in the documentation. Where the description of the subject matter of the contract refers to performance or functional requirements referred to in Art. 101(1) point 1 of the Public Procurement Law, the Contractor may invoke the conformity of the offered construction works, supplies or services with the performance or functional requirements specified by the Contracting Authority with the relevant standards, provided that those standards, technical assessments, specifications and technical reference systems concern the performance or functional requirements specified by the Contracting Authority. The words “or equivalent” shall be added to all indications (names/marks/standards, etc.) specified in the procurement documentation. Consequently, as indicated above, in each such case the Contracting Authority permits the use of equivalent materials, equipment and solutions. In order to confirm compliance with the conditions for participation in the procedure, where appropriate and with regard to the specific contract, the Contractor may rely on the technical or professional capacities or the financial or economic standing of other entities making resources available, irrespective of the legal nature of the legal relationships between it and them, under the rules specified in Arts. 118–123 of the Pzp Act. The Contracting Authority requires the submission of a tender after the Contractor has conducted a site visit – in accordance with the provisions of Chapter 3 point 14 of the SWZ. Failure by the Contractor to conduct a site visit will result in rejection of its tender pursuant to Art. 226(1) point 18 of the Pzp Act. Site visit location: Collegium Iuridicum building, ul. Święty Marcin 90 in Poznań. Site visit dates: a) Primary date: 03.09.2026 at 12:00, b) Alternative date (if the Contractor cannot conduct the site visit on the primary date): 10.09.2026 at 12:00. The cost of the site visit shall be borne by the Contractor. Confirmation that the site visit has been conducted will consist of entering the Contractor on the list of entities participating in the site visit. The site visit should be conducted by an authorised representative of the Contractor. During the site visit, the Contractor’s attorney-in-fact should present the relevant power of attorney to the Contracting Authority. Reconstruction of the Collegium Iuridicum building with the UAM Paramuseum space in the basement. Pursuant to Art. 112 of the Pzp Act, the Contracting Authority specifies the following conditions for participation in the procedure: 1) technical or professional capacity: I. The Contractor will satisfy the condition if it demonstrates that it has at its disposal persons who will be assigned to perform the public contract, responsible for managing construction works, including: - 1 person holding unrestricted construction qualifications to manage construction works in the structural and construction specialisation and having at least 18 months of professional experience in construction work carried out on immovable monuments entered in the register or inventory of a museum that is a cultural institution (in accordance with Art. 37c of the Act on the Protection and Care of Monuments (consolidated text: Journal of Laws of 2024, item 1292, as amended)), - 1 person holding unrestricted construction qualifications to manage construction works in the installation specialisation relating to electrical and electric power networks, installations and equipment, - 1 person holding unrestricted construction qualifications in the installation specialisation relating to heating, ventilation, gas, water supply and sewerage networks, installations and equipment, authorising the person to manage construction works, - 1 person holding unrestricted construction qualifications to manage construction works in the installation specialisation relating to telecommunications networks, installations and equipment, - 1 person holding qualifications to manage conservation and restoration work or to perform such work independently, who meets the requirements referred to in Art. 37a of the Act on the Protection and Care of Monuments (consolidated text: Journal of Laws of 2024, item 1292, as amended). Works may also be managed by citizens of the European Economic Area and the Swiss Confederation who meet the requirements of Art. 12a of the Construction Law Act of 7 July 1994. II. The condition will be satisfied if, during the last 6 years before the tender submission deadline, or, if the period of conducting business is shorter, during that period, the Contractor performed (i.e. completed) at least two contracts for construction works involving the extension/reconstruction of a public institution facility, with a value of: - not less than PLN 15,000,000.00 gross – at least one contract, - not less than PLN 10,000,000.00 gross – at least one contract, provided that at least one contract must concern a historic building (the condition will be deemed satisfied where performance concerning a building individually entered in the register of monuments is demonstrated). The scope of each completed work must include: - general construction and finishing works, including structural works, - sanitary installations, including mechanical ventilation and air conditioning, - electrical installations, - low-current installations, including SSP, KD, LAN and smoke extraction. One contract shall mean one agreement with the Contractor. The contract value is the gross value of the agreement. Assessment of compliance with the condition will be based on the declaration constituting Attachment No. 8. The Contracting Authority states that the aggregation of experience within the required experience condition is not permitted. This condition must be satisfied: a) independently by the contractor, or b) by at least one other entity making its experience available to the contractor, or c) in the case of contractors jointly applying for the contract – independently by at least one of the contractors acting jointly. For the conversion into PLN (Polish zloty) of values indicated in documents submitted to confirm compliance with the conditions for participation in the procedure and expressed in currencies other than PLN, the currency shall be converted according to the average exchange-rate table published by the National Bank of Poland (NBP) on the date the contractor completed the contract or on the date information regarding economic or financial standing was issued, and if no exchange rate was announced on that date, according to the rate most recently announced before that date. Documents confirming compliance with the conditions for participation in the procedure: - List of persons – to confirm compliance with the condition for participation in the procedure referred to in Chapter 7 point 7.2 subpoint (a) I of the SWZ – Attachment No. 7 to the SWZ: List of persons assigned by the contractor to perform the public contract, in particular those responsible for managing construction works, together with information concerning their professional qualifications, authorisations, experience and education necessary to perform the public contract, as well as the scope of the activities performed by them and information on the basis for having those persons at its disposal. - List of construction works (Attachment No. 8 to the SWZ), specifying their type, value, date, place of performance and the entities for which the works were performed, confirming compliance with the condition referred to in Chapter 7 point 7.2 subpoint (a) II of the SWZ, together with evidence specifying whether the construction work was duly performed; the evidence referred to shall consist of references or other documents prepared by the entity for which the construction work was performed or, if for reasons beyond its control the contractor is unable to obtain these documents, other appropriate documents. 2) Condition concerning economic or financial standing: Contractors that have third-party liability insurance covering the conducted business activity related to the subject matter of the contract for an amount of at least PLN 15,000,000.00 may apply for the award of the contract. Documents confirming compliance with the conditions for participation in the procedure: Documents confirming that the contractor has third-party liability insurance covering the conducted business activity related to the subject matter of the contract, indicating the guaranteed sum of that insurance – for the amount referred to in Chapter 7 point 7.2 subpoint (b) of the SWZ.
