Opportunity description

The subject matter of the contract is the reconstruction and extension of the teaching building in order to improve the quality of education, together with adaptation for persons with disabilities and compliance with the applicable fire protection requirements, within the following scope: a) extension to include a passenger lift shaft together with glazed vestibules on each floor, with external stairs enabling direct access between the basement (cellar) floor and the ground floor of the building and the existing ground level, b) associated works within the site development, consisting of the reconstruction of the external stormwater drainage system and the relocation of the metering system outside the building, c) reconstruction of some of the building's rooms due to the need to adapt them to fire protection requirements and improve the conditions for use of the facility by persons with disabilities, consisting of: d) reconstruction of rooms on the first floor together with their ancillary rooms and the adjacent corridor for the purposes of the ICT laboratories being created. 2. The Contracting Authority holds a valid building permit pursuant to Decision No. 52/2025 of 17 April 2025, reference: AGP.6740.57.2025.GM. 3. A detailed description of the subject matter of the contract is set out in the construction design, which includes: the site development design, the architectural and construction design, technical designs, and technical specifications for the execution and acceptance of works. 4. The Contractor is required to prepare two sets of lift documentation in Polish, constituting an attachment to the application to the Office of Technical Inspection (UDT) for an inspection to be carried out before the first decision authorising operation of the lift is issued. . 5. All works must be carried out in accordance with the technical documentation and the applicable technical conditions and regulations. 6. Pursuant to Article 101(4) of the Act, wherever the subject matter of the contract is described by means of standards, technical assessments, technical specifications, and technical reference systems, the Contracting Authority permits solutions equivalent to those described. Furthermore, it shall be assumed that all such references are accompanied by the words "or equivalent". The Contractor is responsible for demonstrating the equivalence of the proposed solution in accordance with Article 101(5) of the Act and under the rules specified therein; in such a case, the Contractor is required to prove, by attaching to the tender the relevant means of proof relating to the subject matter referred to in Articles 104-107 of the Public Procurement Law, that the proposed solutions meet the requirements specified in the description of the subject matter of the contract to an equivalent degree. 7. Where trademarks have been used in the design documentation or the technical specifications for the execution and acceptance of works, this means that they are provided as examples and define only the minimum expected quality parameters and the required standard. The Contractor may use equivalent materials or equipment, but with similar or better technical and quality parameters, the use of which will in no way adversely affect the proper functioning of the solutions adopted in the design documentation. A Contractor that uses equivalent equipment or materials will be required to demonstrate during performance of the contract that the materials and equipment it has used meet the requirements specified by the Contracting Authority. 8. The use of a label in the design documentation means that the Contracting Authority accepts all labels confirming that the construction works, supplies, or services concerned meet requirements equivalent to those of the label specified by the Contracting Authority. Where, for reasons beyond its control, the Contractor cannot obtain the label specified by the Contracting Authority or an equivalent label, the Contracting Authority shall, within a time limit set by it, accept other corresponding means of proof relating to the subject matter, in particular the manufacturer's documentation, provided that the Contractor proves that the construction works, supplies, or services to be performed by it meet the requirements of the specified label or the specified requirements indicated by the Contracting Authority. 9. The use in the design documentation of a requirement to hold a certificate issued by a conformity assessment body or a test report issued by that body as a means of proof confirming compliance with the requirements or characteristics specified in the description of the subject matter of the contract, the tender evaluation criteria, or the contract performance conditions means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The Contracting Authority also accepts other appropriate means of proof, in particular the manufacturer's technical documentation, where the Contractor concerned does not have access to the certificates or test reports or the possibility of obtaining them within the relevant time limit, provided that this lack of access cannot be attributed to the Contractor concerned and that the Contractor concerned proves that the construction works, supplies, or services performed by it meet the requirements or criteria specified in the description of the subject matter of the contract, the tender evaluation criteria, or the requirements related to contract performance. 10. If the description of the subject matter of the contract includes a provision arising from KNR or KNNR indicating the need to use specific equipment with specific parameters in the performance of the contract, the Contracting Authority permits the use of other equipment, provided that this ensures achievement of the intended design parameters and does not create a risk that the completed works will be inconsistent with the technical documentation. 12. The contract is co-financed under the project entitled "Improving the Quality of Vocational Education in the City of Suwałki through the Expansion of the Infrastructure of School Complex No. 4, School Complex No. 6, and the Technical School Complex in Suwałki", implemented under the European Funds for Podlaskie 2021-2027 Programme.
