Opportunity description

1. The subject matter of this contract is the expansion of the NIO-PIB Branch in Gliwice with an accelerator suite equipped with a therapeutic device featuring magnetic resonance imaging functionality. 2. The subject matter of the contract comprises the preparation of design documentation and the execution of the Investment, as well as obtaining an occupancy permit on behalf of the Contracting Authority (under the “design, build”, “equip” formula), entitled: Expansion of the NIO-PIB Branch in Gliwice with an accelerator suite equipped with a therapeutic device featuring magnetic resonance imaging functionality, through the construction of a new therapeutic bunker. The contract includes the preparation of design documentation together with all approvals required by law, obtaining the building permit decision, as well as all demolition and construction and installation work, together with the delivery of medical equipment and apparatus, technological commissioning, and handing over the facility for use. The description of the subject matter of the contract and the contract performance conditions are contained in the following attachments: 1) Functional and Utility Programme – attachment No. 2.2 to the SWZ, 2) Description of the subject matter of the contract – attachment No. 2.3 to the SWZ, 3) Draft contractual provisions to be incorporated into the contract – attachment No. 4 to the SWZ. 3. The Contracting Authority does not permit the submission of partial tenders. 4. Tenders that do not cover the full scope of the subject matter of the contract will be rejected. 5. The Contracting Authority permits the submission of equivalent tenders – the description of equivalence is contained in Chapter IV of the SWZ. 6. The Contracting Authority requires the Contractor to provide a bid bond and requires a performance bond. 7. The Contracting Authority does not provide for an electronic auction or supplementary contracts. 8. Information concerning joint applications by Contractors for the award of the contract is contained in Chapter IX of the SWZ. 9. The Contracting Authority provides for the possibility of amending the provisions of the concluded contract (so-called contractual amendments pursuant to Article 455(1)(1) of the Pzp Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions contained in attachment 4 to the SWZ. Each contract may also be amended in the cases referred to in Article 455(1)(2–4) and Article 455(2) of the Pzp Act. 10. The Contracting Authority has included in the SWZ the information clause arising from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. 11. The Contracting Authority requires insurance under the conditions specified in point 13 of Chapter IV of the SWZ. 12. The Contracting Authority stipulates that a site visit will take place on 14.07.2026 at 10:00 at the Contracting Authority’s premises. 13. The Contracting Authority states that, in this public procurement procedure, certain activities relating to the performance of the contract in question will consist of performing work within the meaning of Article 22 §1 of the Labour Code, in accordance with point 14 of Chapter IV of the SWZ. 14. The subject matter of the contract is financed from a targeted grant from the Medical Fund for the years 2026–2029 to co-finance the task entitled “Optimisation of the diagnostic and therapeutic pathway for cancer patients at the Maria Skłodowska-Curie National Research Institute of Oncology – National Research Institute”. The Contractor is obliged to perform the subject matter of the contract in accordance with the “DNSH Principle” (“do no significant harm”), which is a principle concerning not supporting or conducting an economic activity that causes significant harm (serious harm, has a significant negative impact) to any of the environmental objectives, such as: 1) climate change mitigation, 2) climate change adaptation, 3) sustainable use and protection of water and marine resources, 4) the circular economy, 5) pollution prevention and control, 6) protection and restoration of biodiversity and ecosystems. 16. Pursuant to Article 257 of the Pzp Act, the Contracting Authority provides for the possibility of cancelling the procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract are not awarded to it. 17. The Investment is being carried out under a Medical Fund project within the Strategic Infrastructure Subfund, whose regulations indicate that the Contractor is obliged to submit to inspections conducted by the Minister, in particular to provide the required documentation, provide explanations concerning the implementation of the investment programme, and allow inspectors to enter the site where the investment programme is being implemented. 18. Deadline for completion of the subject matter of the contract: 1. preparation of the “Design and cost-estimate documentation”: within 3 months from the date of conclusion of the contract, 2. completion of construction, installation and finishing works and delivery of equipment within 9 months from the date on which the building permit decision becomes final, 3. delivery of the technical documentation for the accelerator suite demonstrating compliance with radiological protection requirements by 01.04.2028, 4. delivery, commissioning and handing over for operation of the medical equipment, computer equipment and software specified in attachment No. 1 to the “Description of the subject matter of the contract” by 30.06.2028. 19. The subject matter of this contract is the expansion of the NIO-PIB Branch in Gliwice with an accelerator suite equipped with a therapeutic device featuring magnetic resonance imaging functionality. 2. The tender validity period is: 90 days. The tender validity period begins upon expiry of the deadline for the submission of tenders. That day is the first day of the tender validity period. The foregoing means that the tender validity period expires on 09.12.2026. 3. When evaluating tenders in this tender procedure, the Contracting Authority will apply the procedure specified in Article 139(1) of the Pzp Act. Procedure: open. Estimated value: 48,429,620 PLN.
