The subject matter of the contract is the design, obtaining all approvals and permits required by law and necessary to obtain a building permit and commence construction works, execution of works on the basis of the documents obtained, and performance of a natural inventory before the commencement of construction works and after their completion for the task: “Construction of a wetland in the Wielki Las forest district” with the following parameters: Area: approx. 5 ha (+- 10%), Quantity of retained water: min. 40,000 m3 (the calculations must take into account the quantity of surface water in the wetland and the quantity of water retained in the ground), Island area: 0.2 ha (+- 10%) – planned for construction if land is available within the investment area, Embankment length approx. – 90 m + 150 m = approx. 240 m (where possible, material obtained from excavated spoil), Construction of depressions in the bottom of the wetland channel, Slope inclination - n = 1:2 - 1:3, Suggested earth dams with spillways reinforced with stone riprap, and, in justified cases, impoundment and discharge devices (sluice gates): max. 2 units, All design solutions will require the Contracting Authority’s ongoing approval. The Contractor’s obligations include, among other things: Development of a design solution concept and determination of the possibility of achieving the technical parameters on the basis of documents received from the Contracting Authority, Performance of geological surveys for the entire area of the planned investment, Identification of ground and water conditions, with particular consideration of occurring peat deposits and taking into account the habitats of animal species, i.e. beaver and water vole, Submission to the Contracting Authority for approval of the design concept described in point 2.1. Following the Contracting Authority’s approval of the design solutions, preparation of technical documentation in order to obtain: Notification of the conduct of activities/a decision establishing the conditions for conducting activities – Art. 118 UoP, Water-law consent (by obtaining a water-law permit or acceptance of a water-law notification or notifying the authority – Art. 395a.), Building permit, Natural inventory, in the area up to 100 m from the boundary of the facility being constructed, taking into account protected habitats, sites of protected plant species, and habitats of protected amphibian and bird species, before commencing construction works, and submission of 1 copy to the Contracting Authority, containing photographic documentation and files with GPS tracks recorded during the inspection of the facility. If protected species of animals, plants, and fungi are identified in the natural inventory – derogations from the prohibitions indicated in the Nature Conservation Act – Art. 56. The Contractor will submit all obtained decisions—before they become final and binding—arrangements and studies (copies or originals) to the Contracting Authority for the purpose of submitting any comments on their content within 3 days of the date they are obtained. The Contractor will provide the Contracting Authority with: All final and binding decisions, permits, and documents described in point 2.4. Design documentation in paper form (2 copies) and electronic form in the format in which the documents were prepared and additionally in .pdf format, together with the final and binding building permit. Water-law survey together with the final and binding Decision – water-law permit, or confirmation of acceptance of the relevant water-law notification, Technical specifications for the execution and acceptance of works, 2 copies, Natural inventory, 1 copy. As part of the construction works, the Contractor: will provide the Contracting Authority with a construction works schedule divided into stages of construction works, agreed with the Contracting Authority, within 30 days from the date of receipt of the final and binding building permit, but no later than 360 days from the date of signing this Agreement (or within a shorter period in accordance with the submitted tender). Will notify the commencement of works and obtain a construction log. Will perform the subject matter of the agreement in accordance with the technical documentation, applicable regulations, standards, and technical conditions for the execution and acceptance of works, taking into account protection periods for, among others, birds, reptiles, amphibians, and the plants described as occurring on the construction site, the Contracting Authority’s instructions, and the principles of technical knowledge and good construction practice, and will notify that the completed works are ready for acceptance by an entry in the construction log. Will carry out the works while ensuring conditions compliant with occupational health and safety, fire protection, and theft-prevention regulations, and will assume the duties of the occupational health and safety coordinator. On the basis of the hazard table, the Contractor will inform its employees of the safety and health hazards associated with the subject matter of the contract and submit written confirmation that this information was provided to the Contracting Authority. Will keep the construction site in proper order and, after completion of the works, tidy the site and hand it over to the Contracting Authority by the date set for acceptance of the works. Will maintain the construction log constituting documentation of the works carried out. Will organize the construction facilities at its own expense. Will conclude an insurance agreement covering damage that may arise on the construction site in connection with specified fortuitous events and civil liability, and submit it to the Contracting Authority. Will perform an as-built geodetic survey. After completion of the construction works, will prepare a natural inventory in the area up to 100 m from the boundary of the facility being constructed, taking into account protected habitats, sites of protected plant species, and habitats of protected amphibian and bird species before commencing construction works, and submit 1 copy to the Contracting Authority, containing photographic documentation and files with GPS tracks recorded during the inspection of the facility. Will manage earth masses in accordance with the guidelines included in the letter of RDLP Krosno dated 16.06.2011, case ref. ZU-0746-3/26/11. Will prepare documents for notification of completion of the Agreement and notification of completion of construction works. Will obtain a decision authorizing use of the facility from the competent authority. After completion of the works, will provide the originals of all Decisions obtained. Will perform the works in accordance with the principles of technical knowledge and good construction practice, applicable regulations, and standards.
