The subject matter of the contract is the execution of construction works in the building at 26A Pułaskiego Street, owned by the State Treasury, including the renovation of corridors, the stairwell, the bathroom, external (front) stairs, repair of the roof covering together with replacement of the lightning protection system, and modernization of the electrical installation. 2. The detailed scope of the Contractor's obligations is specified in the draft contract constituting Appendix No. 7 to the SWZ. 3. A detailed description of the subject matter of the contract is contained in Appendix No. 2 to the SWZ – Description of the Subject Matter of the Contract (OPZ). Additionally, the Contracting Authority provides bills of quantities as an auxiliary document. 4. The bills of quantities constitute solely an auxiliary and informational document that the Contractor may use when preparing the tender; however, they do not constitute the basis for determining the full scope of the works. 5. All works must be carried out in accordance with the OPZ and the applicable technical conditions and regulations. 6. Required quality guarantee and statutory warranty period, calculated from the date of the final acceptance of the works recorded in a protocol: minimum 60 months, maximum 72 months. 7. Pursuant to Article 101(4) of the Act, wherever the subject matter of the contract is described by means of standards, technical assessments, technical specifications, and technical reference systems, the Contracting Authority permits solutions equivalent to those described. Furthermore, it must be assumed that all such references are accompanied by the words "or equivalent". Demonstrating the equivalence of the offered solution in accordance with Article 101(5) of the Act and under the rules specified therein rests with the Contractor. Where the description is made by means of standards, equivalent solutions are understood to be solutions that ensure the foaming of the minimum requirements specified in the standard at a level no worse than described in the relevant standards. In the case of standards cited in the SWZ (unless specified in detail), current standards are understood. In all other cases (description of the subject matter of the contract by means of technical assessments, technical specifications, and technical reference systems), an equivalent product, material, or system is understood to be one whose technical, functional, and quality parameters are no worse than those listed in the description of the subject matter of the contract. 8. If the description of the subject matter of the contract includes a provision resulting from KNR or KNNR indicating the necessity of using specific equipment with specific parameters in the performance of the contract, the Contracting Authority permits the use of other equipment provided that it ensures achievement of the assumed design parameters and does not create a risk that the completed works will be inconsistent with the technical documentation. 9. Whenever the subject matter of the contract in this SWZ has been specified by indicating trademarks, patents, origin, etc., the intention of the Contracting Authority was to present the "type" of goods meeting the Contracting Authority's requirements. Furthermore, it must be assumed that all such indications are accompanied by the words "or equivalent". Accordingly, the Contractor may offer an equivalent solution that guarantees parameters, technical and quality standards, and functional standards no worse than those indicated in the SWZ. A Contractor relying on solutions equivalent to those described by the Contracting Authority is required to indicate in the submitted tender that the supplies offered by it meet the requirements specified by the Contracting Authority. 10. Pursuant to Article 246(2) of the Public Procurement Law, the quality requirements relating to the main elements comprising the subject matter of the contract have been specified in the Description of the Subject Matter of the Contract and the proposed contractual provisions. 11. The works must be carried out in a manner ensuring the uninterrupted functioning of the building and the service premises located therein. The area where the works are carried out must be appropriately secured against access by unauthorized persons. The Contractor is obliged to coordinate on an ongoing basis with the Contracting Authority the organization and schedule of the works insofar as they affect the functioning of the building and to carry out the works in a manner minimizing inconvenience to users of the facility. 1.
