Opportunity description

1. The subject matter of the contract is the execution of construction works together with the supply and installation of materials, devices and equipment for the investment entitled: ‘NASK Cybersecurity Centre’. The preliminary description of the subject matter of the contract constitutes Appendix No. 16 to the SWZ. The design documentation and the STWiORB constituting Appendix No. 1 to the SWZ contain information of a confidential nature. Therefore, pursuant to Art. 133(3) of the Pzp Act, the Contracting Authority will make the above-mentioned documentation available to those Contractors who directly submit the appropriate request referred to in Chapter III(6) et seq. of this SWZ. 2. The detailed Description of the Subject Matter of the Contract is contained in Appendix No. 1 to the SWZ 3. The Contracting Authority requires that the offered subject matter of the contract, including all ICT products, ICT services and ICT processes used to perform the contract, shall not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 33(4) of the Act of 5 July 2018 on the national cybersecurity system (Journal of Laws of 2026, items 20 and 252), stating their negative impact on the fundamental security interest of the state, 2) an ICT product whose type has been specified in the decision on recognising a supplier as a high-risk supplier referred to in Art. 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or an ICT service or ICT process specified in that decision. If the Contractor offers a solution referred to in point 1) or 2) above, the tender will be subject to rejection pursuant to Art. 226(1), point 17) or point 19) of the Pzp Act. 4. The Contracting Authority does not permit supplies originating from the countries referred to in Chapter V(2), point 4 to be offered in this procedure. This reservation applies to every contractor offering such supplies, irrespective of the origin of the contractor itself. Supply shall mean all Devices, in accordance with the definition contained in Appendix No. 4 to Appendix No. 5 to the SWZ - Model Contract. By the “country of origin of the goods”, the Contracting Authority means the country of origin determined in accordance with Art. 60 of Regulation (EU) No 952/2013 of the European Parliament and of the Council laying down the Union Customs Code, i.e.: 1) in the case of goods wholly obtained - the country in which they were wholly obtained, 2) in the case of goods whose production involved more than one country - the country in which the goods underwent their last substantial, economically justified processing or working, in an undertaking equipped for that purpose, resulting in the manufacture of a new product or representing an important stage of manufacture. 5. Contract performance deadline: The Contractor is obliged to complete all Works covered by the Subject Matter of the Contract and notify their readiness for final acceptance, as referred to in § 10(11), point 2) of the model Contract, within the non-extendable deadline of 97 (ninety-seven) weeks from the date of conclusion of the Contract. 6. NOTE. The Contracting Authority informs that Appendix No. 1 to the SWZ contains information of a confidential nature. Therefore, pursuant to Art. 133(3) of the Pzp Act, the Contracting Authority will make the above-mentioned appendix available to those Contractors who directly submit an appropriate request for access to confidential information in accordance with the template constituting Appendix No. 15 to the SWZ, together with a signed Confidentiality Declaration. The Contractor is obliged to send the request, signed with a qualified electronic signature, via the Procurement Platform through the “questions/information” tab, no later than 10 days before the tender submission deadline. At the same time, the Contracting Authority informs that it may, but is not obliged to, carry out verification and provide the confidential documentation to Contractors who submitted requests or declarations after this deadline. The request together with the declaration shall be signed by a person authorised to represent the Contractor in accordance with the Contractor’s rules of representation or in accordance with the power of attorney granted. The power of attorney must be submitted together with the request for access to confidential information in accordance with the requirements described in Chapter X(7) of the SWZ. The Contracting Authority informs that if the submitted documents are incorrect or incomplete, before the tender submission deadline it will request the Contractor once to supplement or correct the documents referred to above. In the case of Contractors jointly applying for the award of the contract, the provisions of Chapter VI(5) of the SWZ shall apply. Requirements related to protecting the confidential nature of the information have been specified in Appendix No. 15 to the SWZ and in the wording of the Confidentiality Declaration (constituting Appendix No. 15a to the SWZ). 7. A Contractor intending to disclose confidential documents to another person (e.g. subcontractors whose participation is known at the tender preparation stage) or to third parties may do so after obtaining the Contracting Authority’s prior consent in writing, failing which such disclosure shall be null and void; the Contractor is obliged to submit a request for the disclosure of confidential information to third parties/subcontractors, which shall contain a list of the third parties/subcontractors and the Contractor’s declaration that the disclosed Confidential Information will be protected at least in the manner described in Appendix No. 15a. The Contractor is obliged to send the request, signed with a qualified electronic signature, via the Procurement Platform through the “questions/information” tab. 8. Furthermore, the Contracting Authority informs that it will reject the tenders of Contractors to whom it did not provide the documents referred to above, pursuant to Art. 226(1), point 5 of the Act, due to their inability to review the detailed description of the subject matter of the contract.
