The subject of the contract is the performance of general construction works that cannot be planned in the resources of the Municipality of Siemianowice Śląskie. A detailed description of the subject of the contract is contained in the Bill of Quantities – Appendix No. 3 to the SWZ. If one type of work indicated in the cost estimate items is used while another type of work is not used, the Contracting Authority permits changes to the estimated quantities listed in the Contractor's tender cost estimate by changing the quantities within the individual types of work (cost estimate items), while maintaining the gross unit prices (specified in the tender cost estimate) and not exceeding the maximum gross contract value specified in the submitted tender and the concluded contract. The change made by the Contracting Authority will not constitute grounds for claims by the Contractor. The Contracting Authority advises that unforeseen works may arise during the term of the contract; in such a case, the Contractor shall apply the rates and mark-ups in accordance with the tender cost estimate, and the price of materials (excluding purchasing costs) and equipment may not exceed the average “SEKOCENBUD” values from the previous quarter. At the request of the person representing the Contracting Authority, the Contractor shall be obliged to present invoices for the materials purchased. The Contractor shall provide the Contracting Authority with a quality guarantee for the works constituting the subject of the contract for a period of 60 months, calculated from the day following the date of unreserved acceptance by protocol of the entire subject of the contract, performed under the conditions specified in the Specification of Contract Conditions.
