1. The subject of the Contract is the design and execution of construction works for the project entitled: “Works on railway line No. 179 on the Tychy – Bieruń Stary section”, implemented under the European Funds for Infrastructure, Climate and Environment Programme 2021-2027. The entire subject of the Contract includes the execution of the following elements: 1) Design documentation, including: a) preparation of the detailed design, b) preparation of as-built documentation, including geodetic as-built documentation, 2) and works in the following areas: a) track superstructure and subgrade, b) railway traffic control (srk) equipment, c) telecommunications equipment and systems, d) traction network together with its power supply, e) electrical power equipment and systems up to 1 kV, f) engineering structures, g) platforms and buildings, h) pedestrian crossings and level crossings, i) geology. 3) works involving the construction of environmental protection facilities, 4) carrying out the conformity assessment process for structural subsystems within the scope covered by the contract at every stage (design, construction and final subsystem testing) and providing the relevant EC declarations of verification and EC certificates of verification for the subsystems, as well as the Interface Option, which means the optional right of the Contracting Authority to entrust, under the rules described in Appendix No. 15 to the Contract, “Anticipated changes in the scope of interfaces” – Interface Option”, the implementation of changes to railway traffic control equipment with regard to interfaces under the conditions specified in point No. 3.7.8.2.13 of the PFU entitled: “Requirements for srk equipment enabling its connection with other srk equipment/systems – interfaces” The Detailed Description of the Subject of the Contract is presented in the Functional and Utility Programme (PFU), constituting Volume III of the SWZ. 2. Contract performance period: 1) Basic scope – 27 months from the date of conclusion of the contract in accordance with § 4 of the Contract Conditions, contained in Volume II of the SWZ, including: 1. completion of all Works (subject to the point below), confirmed by the Contracting Authority’s completion of the Last Final Acceptance, including delivery to the Contracting Authority of complete as-built documentation and delivery to the Contracting Authority of a complete set of documents related to the certification process – 22 months from the date of conclusion of the Contract, 2. delivery to the Contracting Authority of authorisations for placing structural subsystems in service, in accordance with the Railway Transport Act – no longer than within 8 months from the date of the Contracting Authority’s completion of the Last Operational Acceptance 2) Interface Option – not less than 6 months, provided that the performance deadline specified by the Contracting Authority shall not be longer than 4 years from the date of activation of the Interface Option. The Contracting Authority shall have the right to activate the Interface Option throughout the entire period of performance of the Works and the Works warranty period, no later than before the expiry of the warranty period for the scope of Works concerning railway traffic control equipment. 1.
