1. The subject matter of the contract is: Preparation of comprehensive design documentation (for Stage I and Stage II) (including, inter alia: • a detailed multi-discipline design concept; • a demolition design and obtaining a decision authorizing the demolition of buildings; • a construction design (understood as: a plot or site development design, an architectural and construction design, a technical design) and obtaining a building permit decision; • a detailed design; • bills of quantities and investor’s cost estimates; • technical specifications for the execution and acceptance of works; • as-built documentation; • operating documentation for the building and equipment; • siding operating regulations agreed with PKP PLK S.A.; • a fire scenario – agreed with the territorially competent unit of the State Fire Service; • fire safety instructions; • roof snow-removal instructions; Execution of basic construction works, including: • preparatory works; • demolition works; • protective works; • accompanying works (necessary for the execution of the basic works) • clean-up works during the execution of the basic works, as well as after their completion. Under this contract, the Contractor is required in particular to obtain: power supply conditions, collection conditions, conditions for removing conflicts, and all consents and arrangements required by law for the implementation and acceptance of the investment. With regard to the decision on environmental conditions, the Contracting Authority will provide the decision to the Contractor after it has been issued by the Authority. Due to the amendment of the MPZP, the planned date for obtaining the DŚU decision is December 2026. The Contractor is required to meet all DŚU requirements at the stage of preparing the design documentation and executing the works. The investment will consist of designing, constructing and equipping the Koleje Śląskie technical facility for servicing railway rolling stock, entitled "Construction of a new technical facility in Gliwice", together with internal installations (water and sewerage, central heating, mechanical ventilation, compressed-air installation, electrical and telecommunications installations) and site development: pedestrian routes, an internal road, a car park, a sand silo, fencing, demolition of structures and elements of the existing technical infrastructure, construction of external internal installations (water and sewerage, stormwater drainage, electrical, external lighting, telecommunications, railway traffic control), reconstruction of conflicting existing utility installations, construction of connections, and construction of the track system and overhead contact line at 39 Bojkowska Street in Gliwice in two stages. 2. A detailed description of the subject matter of the Contract is contained in Appendix No. 2 to the SWZ (Draft contractual provisions). 3. The Contracting Authority envisages applying the procedure referred to in Art. 139(1) of the PZP Act, i.e. the Contracting Authority will first examine and evaluate the tenders and will then carry out the eligibility assessment of the Contractor whose tender received the highest score, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the Procedure. 4. The procedure will be conducted in Polish using electronic means of communication via the Contracting Authority’s Procurement Platform at: https://kolejeslaskie.eb2b.com.pl Use of the Platform is free of charge. Amendments and clarifications to the SWZ and other procurement documents directly related to the Procedure will be made available on the Platform. All statements, notices, clarifications and other documents in the Procedure, as well as the contract, will be drawn up in Polish. 5. Planned contract performance period: from the date of conclusion of the contract until 2 November 2028. Detailed deadlines are specified in the Draft contractual provisions (Ppu) constituting Appendix No. 2 to the SWZ. Specifying the contract performance deadline by setting a date is justified by an objective reason related to EU funding for the project in accordance with Section IV, paragraph 4.26 of the SWZ. This regulation makes it possible to finance the subject matter of the contract (to a significant extent) from EU funds, ensuring that the Contracting Authority fulfils the grant agreement, i.e. satisfies the Contracting Authority’s obligations arising from the above agreement. The indicated deadline is the planned deadline for completing performance of the contract, which means that it may be changed on the basis of an amendment to the Ppu. The contract covers the preparation of all design documentation: for Stage I and Stage II and the internal overhead contact line in the hall. In accordance with the provisions of the PPU, § 20(3), the final decision on exercising the option right and the scope of the option rests with the Contracting Authority and will be made no later than 31.03.2028. The Contracting Authority is not dividing the contract into lots or awarding the contract in lots due to the technical impossibility of such division and of achieving compatibility among the facilities comprising the subject matter of the contract. Moreover, dividing the contract would cause excessive technical difficulties and generate an increase in the cost of performing the contract. It would also jeopardize the contract performance deadline due to the need to coordinate the activities of the individual contractors with one another. Procedure: open.
