Opportunity description
1. The subject matter of the contract is the granting and servicing of a long-term loan in the amount of PLN 47,576,000.00 (in words: forty-seven million five hundred seventy-six thousand Polish zlotys 00/100), intended to finance the deficit and repay previously contracted loans, with the possibility of not using the full loan amount without additional commissions and fees. The loan will be repaid in the years 2027–2052 from the County’s own revenues, with the possibility of extending the loan repayment period and changing the amount of the annual principal instalments during the repayment period. The Contracting Authority requires the contractor or subcontractor to employ, under an employment contract, the person(s) performing activities within the scope of contract performance where the performance of such activities constitutes work performed in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277, as amended), i.e. the employment of persons who will perform activities directly related to the provision of the loan-granting service, namely: disbursement of the loan in the banking system, calculation of bank interest due, and provision of information on the current status of the loan, unless these activities are performed by persons as part of their own business activity. 3. In order to verify the employment, by the contractor or subcontractor under an employment contract, of persons performing the activities specified by the Contracting Authority within the scope of contract performance, the Contracting Authority provides for the possibility of requesting in particular: 1) a statement from the employed worker, 2) a statement from the contractor or subcontractor concerning the employment of the worker under an employment contract, 3) a copy, certified as a true copy of the original, of the employed worker’s employment contract, 4) other documents containing information, including personal data, necessary to verify employment under an employment contract, in particular the first name and surname of the employed worker, the date on which the employment contract was concluded, the type of employment contract and the scope of the worker’s duties. 4. Copies of the documents referred to in paragraph 3 should be anonymised in a manner ensuring the protection of workers’ personal data, in accordance with the provisions of the Act of 10 May 2018 on the Protection of Personal Data, i.e. in particular without the workers’ addresses and PESEL numbers). The worker’s first name and surname are not subject to anonymisation. Information such as the date of conclusion of the contract, the type of employment contract and the working-time basis should remain identifiable. 5. The Contracting Authority agrees that the Contractor or subcontractor may submit a statement confirming that the indicated persons are employed under an employment contract. The statement should contain in particular: identification of the entity submitting the statement, the date of submission of the statement, an indication that the activities covered by the request are performed by persons employed under an employment contract, together with the number of such persons, their first names and surnames, the type of employment contract and working-time basis, and the signature of the person authorised to submit the statement on behalf of the entity submitting it. 6. If, at the Contracting Authority’s request, the Contractor fails to provide documents confirming the employment by the Contractor or subcontractors under employment contracts of persons who will perform activities directly related to the provision of the loan-granting service, namely: disbursement of the loan in the banking system, calculation of bank interest due, and provision of information on the current status of the loan, unless these activities are performed by persons as part of their own business activity, the Contracting Authority will impose a contractual penalty of PLN 300 for each day of delay in providing the documents. 7. No later than on the date of signing the contract, the Contracting Authority will provide the selected Contractor with a current certificate from the competent head of the tax office confirming that there are no tax arrears and current certificates from the competent branch of the Social Insurance Institution confirming that there are no arrears in the payment of health and social insurance contributions.
