Opportunity description

1. The subject of the contract is the comprehensive design and construction of a pedestrian and bicycle path in the Zakroczym Municipality, together with a section of pedestrian path, bicycle parking, lighting, signage, street furniture, landscaping, and all works and activities necessary to obtain a complete, safe facility ready for use. 2. The contract in the Zakroczym Municipality is being carried out for the implementation of the joint investment project entitled “Development of urban mobility in Nowy Dwór County”, under European Funds for Mazovia 2021-2027 – Priority III “European Funds for the development of urban mobility in Mazovia” – Measure 3.2 “Urban mobility under ITI” – Project type: “Bicycle and pedestrian infrastructure”, co-financed by the European Regional Development Fund under a partnership agreement concluded between Nowy Dwór County, Pomiechówek Municipality, Zakroczym Municipality, the City of Nowy Dwór Mazowiecki, and Nasielsk Municipality. 3. The detailed description is set out in Attachment No. 2 to the SWZ entitled PFU, prepared for tasks carried out throughout the entire Zakroczym Municipality, and Attachment No. 3 to the SWZ, OPZ, prepared on the basis of the PFU for the task carried out solely by the Zakroczym Municipality. 4. The detailed scope and method of performing the subject of the contract have been specified in the Draft contractual provisions – Attachment No. 1 to the SWZ. 5. The scope of the contract includes in particular: 1) conducting a site survey, geodetic measurements, inventory, and required ground tests; 2) obtaining a map for design purposes and data from the geodetic resources; 3) preparing a concept and complete multidisciplinary design documentation; 4) obtaining all required arrangements, opinions, technical conditions, consents, decisions, and permits; 5) preparing and obtaining approval for temporary and permanent traffic management; 6) providing author’s supervision throughout the entire period of the works; 7) carrying out preparatory, demolition, and earthworks; 8) constructing the structure and surface of the pedestrian and bicycle path, pedestrian path, and bicycle parking; 9) installing edging, curbs, drainage elements, and site safeguards; 10) constructing cable-based LED lighting, including power supply, controls, grounding, and measurements; 11) installing vertical and horizontal signage and traffic safety devices, if required; 12) supplying and installing a bicycle repair station, inverted “U” racks, and a recreational shelter; 13) restoring adjacent areas, spreading topsoil, sowing, and clearing up the site; 14) carrying out examinations and tests and preparing as-built documentation and an as-built geodetic survey; 15) obtaining, on behalf of the Contracting Authority, documents permitting the lawful use of the facility, if required; 16) as well as temporary and accompanying works, supplies, services, fees, arrangements, and activities whose necessity can be foreseen on the basis of the PFU, attachments, site inspection, professional knowledge, and applicable regulations, even if they have not been listed separately. 6. The investment will be implemented within the administrative area of the Mazowieckie Voivodeship, in Nowy Dwór County, in the Zakroczym Municipality, on cadastral plot No. 10/18 within precinct 0008 Poligon, adjacent to a road owned by the Zakroczym Municipality. 7. The Contracting Authority requires the Contractor or Subcontractor to employ, under an employment relationship, persons involved in the performance of the contract who will perform activities directly related to the execution of the works, i.e. employees performing manual work and operating equipment and tools during the execution of construction works. 8. The required warranty period for the prepared design documentation, completed construction works, materials supplied and incorporated, and equipment supplied and installed by the Contractor is a minimum of 5 years from the date of signing the final defect-free works acceptance report. The Contractor shall provide a statutory warranty for defects for a period no shorter than the warranty period. Offering an extended warranty period beyond the required period will receive additional points in accordance with the SWZ. 9. Performance of the subject of the contract is governed by Polish law, including in particular the Act of 7 July 1994 – Construction Law and the Act of 11 September 2019 – Public Procurement Law. 10. The Contractor is responsible for the proper preparation of the design documentation and for the quality of the works performed and materials used. 11. The works must be performed in accordance with applicable regulations (in particular the Construction Law, occupational health and safety, fire protection, and industry-specific regulations), as well as in accordance with the principles of technical knowledge, with due care, proper organization of work, and assurance of good quality. 12. Materials used by the Contractor during performance of the subject of the contract should be brand new and, in terms of quality, meet the requirements for products approved for marketing and use in construction, in accordance with Article 10 of the Construction Law and the quality and grade requirements specified in the OPZ and the Technical Specification for the Execution and Acceptance of Construction Works. The Contractor shall submit documents confirming compliance with the requirements to the Contracting Authority before the materials are incorporated, under penalty of an order to demolish the completed works and remove the incorporated materials at the Contractor’s expense. 13. All materials, products, and equipment used must have current documents (certificates, approvals, and declarations of conformity) permitting their use in construction in accordance with the regulations applicable in this regard. 14. The Contractor is obliged to complete the contract within a maximum of 13 months from the date of conclusion of the contract, including completion of the design work within a maximum of 8 months from the date of conclusion of the contract. 15. The subject of the Contract is implemented in two stages: 1) Stage I – preparation of design documentation, 2) Stage II – execution of construction works. 1.
