Opportunity description

1. The subject matter of the contract is the supply of IT and office equipment to IHAR-PIB in Radzików, including installation and training of the Contracting Authority’s personnel. 2. A detailed description of the subject matter of the contract is included in the Description of the subject matter of the contract (Attachments No. 1.1–1.4 to the SWZ, corresponding to the respective lots). 3. The procedure is conducted as an open tender pursuant to Art. 132 of the Act of 11 September 2019, Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320, as amended), hereinafter the “Act” or “uPzp”, with an estimated value equal to or exceeding the “EU threshold” within the meaning of Art. 3 of the Act. 4. The Contracting Authority permits the submission of tenders for individual lots. The Contractor may submit a tender for any number of lots of the contract. 5. The Contracting Authority does not limit the number of lots that may be awarded to the same Contractor. 6. Where, in describing the subject matter of the contract, the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101(2) and (3) of the Pzp Act, solutions equivalent to those described are permitted. Every phrase in the SWZ referring to standards, technical assessments, technical specifications and technical reference systems must be read with the accompanying qualification “or equivalent”. 7. If the description of the subject matter of the contract contains references to trademarks, patents or origin, they must be understood in accordance with Art. 99(5)–(6) of the Pzp Act as being justified by the specific nature of the subject matter of the contract and because the Contracting Authority cannot describe the subject matter of the contract using sufficiently precise terms. In such circumstances, the Contracting Authority permits equivalent solutions to be offered, indicating that the minimum requirements to be met by equivalent solutions are requirements (functionalities) no worse than the parameters (functionalities) specified in the Description of the subject matter of the contract. 8. A Contractor relying on solutions equivalent to those described by the Contracting Authority is obliged to indicate in the tender which tender items contain equivalent solutions, together with their description or standards, and to demonstrate that the equivalent solutions offered meet the requirements specified by the Contracting Authority, in particular by means of subject-matter evidence. 9. The Contracting Authority does not permit the submission of variant tenders. 10. The Contracting Authority does not envisage concluding a framework agreement. 11. The Contracting Authority does not envisage selecting a tender using an electronic auction. 12. The Contracting Authority does not envisage reimbursing the costs of participation in the procedure, subject to Art. 261 uPzp. 13. The Contracting Authority does not envisage the requirements referred to in Art. 96(1) uPzp. 14. The Contracting Authority does not permit tenders to be submitted in the form of electronic catalogues or electronic catalogues to be attached to a tender. 15. The Contracting Authority does not envisage the possibility of awarding contracts referred to in Art. 214(1)(8) uPzp. 16. Pursuant to Art. 257(1) uPzp, the Contracting Authority envisages the possibility of cancelling the procurement procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 17. Source of funding: The contract is co-financed by the European Union under the National Recovery and Resilience Plan, pursuant to Agreement No. IHAR.KPOD.01.19-IP.04-0032/23 on covering the project with non-repayable support from the development plan (KPO), concerning part of investment A2.4.1, for the implementation of the project entitled “Central Laboratory for Phenotyping and Genotyping of Agricultural Plants”, concluded on 23.11.2023.
