Opportunity description

1. The subject matter of the contract is the supply of monitors. 2. The Contracting Authority permits the submission of tenders for individual lots, divided into Tasks: 1) Task No 1 – Supplies of monitors; 2) Task No 2 – Supplies of touch-screen monitors. 3. A detailed description of the subject matter of the contract is provided in Annex No 5 to the SWZ – as applicable to the Task – and Chapter XIX of the SWZ. 4. The Contracting Authority requires the Contractor's Tender to specify the manufacturer and the type, model, symbol of the assortment or other data unambiguously identifying the assortment offered. If the tender does not specify data unambiguously identifying the assortment offered, the Contracting Authority will reject the tender pursuant to Article 226(1)(5) of the Act. The term “Manufacturer” shall mean the name of the company under which the assortment offered is sold, or the entrepreneur placing the goods on the market in the territory of the Republic of Poland. 5. The Contracting Authority requires that the ICT products offered do not include: 1) ICT products indicated in the recommendation referred to in Article 34(4) of the Act of 5 July 2018 on the national cybersecurity system, finding that they have an adverse impact on the fundamental security interest of the state; 2) an ICT product whose type has been specified in the decision on recognising a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system; Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Act. 6. Information clause concerning the processing of personal data Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the “GDPR”, the Contracting Authority hereby informs you that: 1) the controller of your personal data is the Warsaw Metropolitan Police Commander; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: iod@ksp.policja.gov.pl 3) your personal data will be processed pursuant to Article 6(1)(c) of the GDPR for the purpose connected with the public procurement procedure conducted under the open procedure for Supplies of monitors, ref. No: WZP-2189/26/117/Ł; 4) the recipients of your personal data will be persons or entities to whom the procedure documentation is made available pursuant to Article 18 and Article 74(1) of the Act; 5) your personal data will be stored, pursuant to Article 78 of the Act, for a period of 4 years from the date of completion of the public procurement procedure, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide your personal data directly concerning you is a statutory requirement laid down in the provisions of the Act, connected with participation in the public procurement procedure; the consequences of failing to provide specified data arise from the Act; 7) with regard to your personal data, decisions will not be made by automated means, pursuant to Article 22 of the GDPR; 8) you have: a) pursuant to Article 15 of the GDPR, the right of access to personal data concerning you; b) pursuant to Article 16 of the GDPR, the right to rectification of your personal data*; c) pursuant to Article 18 of the GDPR, the right to request that the controller restrict the processing of personal data, subject to the cases referred to in Article 18(2) of the GDPR**; d) the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of personal data concerning you infringes the provisions of the GDPR; 9) you do not have: a) in connection with Article 17(3)(b), (d) or (e) of the GDPR, the right to erasure of personal data; b) the right to data portability referred to in Article 20 of the GDPR; c) pursuant to Article 21 of the GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) of the GDPR. *Explanation: exercising the right to rectification may not result in a change to the outcome of the public procurement procedure or a change to the provisions of the contract to an extent inconsistent with the Act, and may not compromise the integrity of the record and its annexes. **Explanation: the right to restriction of processing does not apply to storage, for the purpose of ensuring the exercise of legal remedies or for the purpose of protecting the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State. 7. The Contractor is bound by the tender for 90 days from the expiry of the deadline for submission of tenders, i.e. until 09.12.2026, with the first day of the period during which the tender is binding being the day on which the deadline for submission of tenders expires. 8. In each Task, pursuant to Article 139 of the Act, the Contracting Authority provides for a reversed order of activities, i.e. it may first examine and evaluate the tenders and then carry out the qualitative selection of the Contractors whose tenders are evaluated most highly and rank from 1 to 3 in the tender ranking, with regard to the absence of grounds for exclusion. 9. The Contracting Authority – in none of the tasks – requires the submission of means of proof relating to the subject matter together with the tender. 1.
