Opportunity description

1. Contractors who meet the conditions specified in Art. 57 of the Public Procurement Law and Art. 112 sec. 2 of the Public Procurement Law may participate in the award of the contract, i.e.: 1) are not subject to exclusion 2) meet the conditions for participation in the procedure concerning: a) capacity to conduct business transactions The Contracting Authority does not establish a detailed condition for participation in the Procedure. b) authorisations to conduct specific business or professional activities The Contracting Authority does not establish a detailed condition for participation in the Procedure. c) economic or financial standing The Contracting Authority does not establish a detailed condition for participation in the Procedure. d) technical or professional capacity The Contracting Authority does not establish a detailed condition for participation in the Procedure LIST OF STATEMENTS OR DOCUMENTS TO BE SUBMITTED BY CONTRACTORS TO CONFIRM COMPLIANCE WITH THE CONDITIONS FOR PARTICIPATION IN THE PROCEDURE 1. To demonstrate the Contractor's compliance with the conditions referred to in Art. 57 of the Public Procurement Law, the Contractor shall submit: a) a statement on compliance with the conditions for participation in the procedure – duly signed by the person(s) authorised to represent the Contractor. The Contractor shall submit the relevant statement in the form of a single document constituting Appendix No. 4 to the Specification (ESPD form). 2. To confirm the absence of grounds for exclusion from the Procedure under the circumstances referred to in Art. 108 of the Public Procurement Law and Art. 109 sec. 1 point 1 and point 4 of the Public Procurement Law, as well as Art. 7 sec. 1 of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security, consolidated text Journal of Laws of 2024, item 507, and Art. 5k sec. 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 229 of 31.07.2014, p. 1, as amended), the Contractor shall submit: a) a statement on the absence of grounds for exclusion from the procedure – duly completed and signed by the person(s) authorised to represent the Contractor. The Contractor shall submit the relevant statement in the form of a single document constituting Appendix No. 4 to the Specification (ESPD form); b) statements that the Contractor is not subject to exclusion from the procedure pursuant to Art. 7 sec. 1 of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security (consolidated text Journal of Laws of 2025, item 514) and is not subject to the prohibition on the award or continued performance of any public contracts pursuant to Article 5k sec. 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 229 of 31.07.2014, p. 1, as amended) – duly completed and signed by the person(s) authorised to represent the Contractor – Appendix No. 2 to the Specification. 1. The subject matter of the contract is the supply of medical devices according to 68 packages to the Contracting Authority's registered office (os. Złotej Jesieni 1, Kraków), in accordance with the description and requirements contained in Appendix No. 1 to this Specification. 2. The expiry date / warranty period for the subject matter of the contract may not be shorter than 12 months from the date of delivery. 3. At the Contracting Authority's request, the Contractor undertakes to conduct training for the Contracting Authority's personnel at its registered office (os. Złotej Jesieni 1, Kraków), together with the first delivery of goods to the Hospital Pharmacy, on a date agreed in writing with the Contracting Authority, but no later than within 30 days from the date of conclusion of the contract. 4. The Contractor shall be required to submit to the Hospital Pharmacy an attendance list from the training referred to in sec. 3, bearing the signatures of the trained users confirming their actual attendance, within 5 working days from the date on which the training was conducted. 5. The Contracting Authority reserves the right, at the stage of examining and evaluating tenders, to request that Contractors provide samples of the offered subject matter of the contract for testing and verification of the Contractor's technical or professional capacity to perform the contract. The related costs shall be borne by the Contractor. 6. The remaining terms and conditions of the contract are specified in the draft contract constituting Appendix No. 3 to the Specification.
