Opportunity description
1. The subject matter of the contract is the supply of medical devices according to 37 packages to the Contracting Authority’s premises (os. Złotej Jesieni 1, Kraków), in accordance with the description and requirements contained in Appendix No. 1 to the Specifications. 2. The expiry date / warranty period of the subject matter of the contract may not be shorter than 12 months from the date of delivery. 3. At the Contracting Authority’s request, the Contractor undertakes to provide training for the Contracting Authority’s personnel at its premises (os. Złotej Jesieni 1, Kraków) together with the first delivery of the goods to the Hospital Pharmacy, on a date agreed in writing with the Contracting Authority, but no later than 30 days from the date of conclusion of the contract. 4. The Contractor shall be required to submit to the Hospital Pharmacy an attendance list from the training referred to in paragraph 3, bearing the signatures of the trained users confirming their actual attendance, within 5 working days from the date on which the training was conducted. 5. The Contracting Authority reserves the right, at the stage of examining and evaluating tenders, to request Contractors to provide samples of the offered subject matter of the contract in order to test them and verify the Contractor’s technical or professional capacity to perform the contract. The related costs shall be borne by the Contractor. 6. The remaining terms and conditions of the contract are set out in the draft contract constituting Appendix No. 3 to the Specifications. CONDITIONS FOR PARTICIPATION IN THE PROCEDURE 1. Contractors who meet the conditions specified in Article 57 of the Pzp Act and Article 112(2) of the Pzp Act may participate in the award procedure, i.e.: 1) are not subject to exclusion 2) meet the conditions for participation in the procedure concerning: a) capacity to conduct business activities The Contracting Authority does not establish a specific condition for participation in the Procedure. b) authorization to conduct specific business or professional activities The Contracting Authority does not establish a specific condition for participation in the Procedure. c) economic or financial standing The Contracting Authority does not establish a specific condition for participation in the Procedure. d) technical or professional capacity The Contracting Authority does not establish a specific condition for participation in the Procedure. 3. Contractors who are not subject to exclusion from the procedure pursuant to Article 108 of the Pzp Act and Article 109(1), points 1 and 4, of the Pzp Act, and who are not subject to exclusion from the procedure pursuant to Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2022, item 835), and who are not subject to a prohibition on the award or continued performance of any public contracts pursuant to Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 229 of 31.07.2014, p. 1, as amended), may participate in the Procedure. The assessment of whether the grounds for exclusion from the Procedure referred to in paragraph 3 are met shall be carried out according to the “subject to exclusion – not subject to exclusion” formula, based on the statement and documents submitted by the Contractor referred to in Chapter X.1. 4. In order to confirm compliance with the conditions for participation in the procedure and the absence of grounds for exclusion from the procedure, the Contracting Authority requires the submission of the Contractor’s self-declaration in the form of the European Single Procurement Document (ESPD). In the case of Contractors jointly applying for the award of the contract, each Contractor shall submit the ESPD form. The template of the ESPD form is specified in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 (OJ EU L 3/16), the template of which constitutes Appendix No. 4 to the Specifications. 1.
