1. The subject of the contract is the successive supply by the Contractor to the Contracting Authority of surgical drapes (hereinafter referred to as the goods) in the types and quantities specified in the price form constituting Annex No. 2 to the SWZ and in accordance with the draft contractual provisions constituting Annex No. 4 to this SWZ. 2. Detailed description of the subject of the contract by task: Task No. 1: Supplies of endovascular sets Task No. 2: Supplies of sets for angiographic procedures Task No. 3: Supplies of drapes for cardiac surgery Task No. 4: Supplies of sets for intravitreal injections, EYE drapes Task No. 5: Supplies of drapes for pacemaker removal Task No. 6: Supplies of surgical adhesive dressings (DRESSINGS) in accordance with the detailed description of the subject of the contract contained in the Price Form constituting Annex No. 2 to the SWZ. The Contractor may submit a tender for one, several or all parts. During the examination and evaluation of tenders, the Contracting Authority will consider each task separately. 3. In the event of no demand for the assortment covered by the subject of the contract, the Contracting Authority reserves the right not to order part of the assortment specified in Annex No. 2 to the SWZ, subject to paragraph 4. The Contractor shall not be entitled on this account to any claims for damages or claims based on any other legal basis, to which the Contractor agrees. 4. The Contracting Authority guarantees that the minimum value of supplies made by the Contractor under a given task throughout the entire term of the contract will amount to 70% of the maximum value of the Contractor's remuneration under that task within the basic scope, as specified in the price form constituting Annex No. 2 to the SWZ. The Contracting Authority hereby informs that, in the proceedings in question conducted under the open tender procedure, it provides for the possibility of applying the procedure referred to in Article 139(1) of the Public Procurement Law. When applying the aforementioned procedure, the Contracting Authority will first examine and evaluate the tenders and will then perform the eligibility assessment of the Contractor whose tender was rated highest with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings. The subject of the contract is the successive supply by the Contractor to the Contracting Authority of surgical drapes (hereinafter referred to as the goods) in the types and quantities specified in the price form constituting Annex No. 2 to the SWZ and in accordance with the draft contractual provisions constituting Annex No. 4 to this SWZ.
