Tail lift capacity: minimum 1,000 kg. 5.2. Platform dimensions: a) Length: minimum 1,450 mm – maximum 1,650 mm. b) Width: minimum 2,560 mm. The Contracting Authority permits a vehicle with a Permissible Gross Weight of 8,800 kg. 1) The Contracting Authority provides for the possibility of applying the procedure specified in Article 139(1) of the PZP Act, the so-called “reverse procedure”. 2) Pursuant to Article 20(2) of the PZP Act, the contract award procedure shall be conducted in Polish. 3) The Contracting Authority does not provide for the award of contracts referred to in Article 214(1)(8) of the PZP Act. 4) The Contracting Authority does not permit the submission of a tender providing for a method of performing the contract different from that specified in the SWZ (variant tender). 5) The Contracting Authority does not divide the contract into lots. Accordingly, the Contracting Authority does not permit the submission of partial tenders referred to in Article 7(15) of the PZP Act. Reasons for not dividing the contract: The contract cannot be divided into lots due to the type of contract. The subject matter of the contract is the delivery of 1 vehicle with a permissible gross weight of up to 7.5 Mg with a tail lift, 6) Pursuant to Article 95(1) of the PZP Act, the Contracting Authority does not require the Contractor or Subcontractor to employ, under an employment contract in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (consolidated text: Journal of Laws of 2023, item 1465, DELIVERY COMPLETION DEADLINE – up to 120 days from the date of conclusion of the contract, of 2024, items 878, 1222, of 2025, item 277), persons performing activities during the performance of the contract. SUBJECT-MATTER EVIDENCE, 1.1) List of deliveries, 2) CONFIRMING THE ABSENCE OF GROUNDS FOR EXCLUDING THE CONTRACTOR FROM PARTICIPATION IN THE PUBLIC PROCUREMENT PROCEDURE: 2.1) Information from the National Criminal Register concerning: a) Article 108(1)(1) and (2) of the PZP Act, b) Article 108(1)(4) of the PZP Act, concerning a ruling prohibiting participation in public procurement as a penal measure, issued no earlier than 6 months before its submission; 2.2) A statement by the Contractor, within the scope of Article 108(1)(5) of the PZP Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws of 2024, item 594), as another Contractor that submitted a separate partial tender, or a statement that it belongs to the same capital group, together with documents or information confirming that the partial tender was prepared independently of another Contractor belonging to the same capital group; 2.3) An extract or information from the National Court Register or the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the PZP Act, issued no earlier than 3 months before its submission, if separate regulations require entry in a register or records; 2.4) A statement by the Contractor confirming that the information contained in the Statement referred to in Chapter I point 6 of the SWZ (JEDZ) remains current with regard to the grounds for exclusion from the procedure indicated by the Contracting Authority, referred to in: a) Article 108(1)(3) of the PZP Act, b) Article 108(1)(4) of the PZP Act, concerning a ruling prohibiting participation in public procurement as a preventive measure, c) Article 108(1)(5) of the PZP Act, concerning the conclusion of an agreement with other Contractors aimed at distorting competition, d) Article 108(1)(6) of the PZP Act. Note! 1. The Contractor is not required to submit subject-matter evidence already held by the Contracting Authority if the Contractor identifies such evidence and confirms its correctness and validity. The Contracting Authority will not request the submission of subject-matter evidence if: • it can obtain it using free and publicly accessible databases, in particular public registers within the meaning of the Act of 17 February 2005 on the computerisation of the activities of entities performing public tasks, provided that the Contractor has indicated in the Statement referred to in Chapter I point 6 of the SWZ (JEDZ) the data enabling access to such evidence; • the subject-matter evidence is a statement whose content corresponds to the scope of the Statement referred to in Chapter I point 6 of the SWZ (JEDZ). 2. The subject-matter evidence indicated in point 6.1 may be replaced by a valid public procurement contractor certificate referred to in Article 124(2) of the Pzp Act, solely to the extent that the certificate confirms the absence of grounds for exclusion or fulfilment of the conditions for participation in the procedure to the extent corresponding to the requirements specified in the SWZ. The certificate does not replace subject-matter evidence concerning grounds for exclusion not covered by certification, in particular Article 108(1)(6) of the Pzp Act, Article 109(1)(6) of the Pzp Act, Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security, as well as circumstances arising during this procedure and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No L 229 of 31 July 2014, p. 1). 3. The certificate replaces subject-matter evidence solely to the extent covered by valid certification and indicated by the contractor in the JEDZ statement. If the certificate covers only some of the grounds for exclusion or part of a condition for participation in the procedure, or confirms fulfilment of the condition at a level lower than required in the SWZ, the contractor shall submit subject-matter evidence for the remaining scope. 4. To the extent arising from a valid certificate, the contracting authority shall not require other subject-matter evidence from the contractor, subject to Article 124(4) of the Pzp Act and Article 31(6) of the Act on the Certification of Public Procurement Contractors.
