Opportunity description

The subject matter of the contract is the provision of training courses for employees of educational institutions and public administration to enhance intercultural competences. The procedure is conducted as an open tender pursuant to Art. 132 of the Pzp Act. Matters not regulated in the SWZ shall be governed by the provisions of the Pzp Act. Pursuant to Art. 359 of the Pzp Act, when awarding contracts for social services, the provisions of the Act applicable to classic contracts with a value equal to or exceeding the EU thresholds shall apply—if the value of the contract expressed in Polish zlotys is equal to or exceeds the equivalent of EUR 750,000—with the possibility of excluding the application of selected provisions of the Pzp Act referred to in Art. 360 of that Act. Pursuant to Art. 139(1) of the Pzp Act, the Contracting Authority informs that it will first examine and evaluate the tenders and will then perform the qualification of the Contractor whose tender was rated highest with respect to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 1. The procedure is conducted in Polish, electronically, via the Purchasing Platform. 2. Communication between the Contracting Authority and the Contractors, including all declarations, requests, notices, and information, should be transmitted via the Purchasing Platform using the “Send a message to the contracting authority” form. If the contractor is already logged into the platformazakupowa.pl system, the “Send a message to the contracting authority” message form is unlocked and does not require additional verification. If the contractor is not logged in before beginning to complete the “Send a message to the contracting authority” form, the contractor is required to unlock the form by confirming their identity. The form may be unlocked by entering a one-time authorization code (without the need to create an account) or by logging into the platformazakupowa.pl system (recommended). 3. The date on which declarations, requests, notices, and information are transmitted (received) shall be deemed to be the date on which they are sent via the Purchasing Platform by clicking the “Send a message to the contracting authority” button, after which a message confirming that the message has been sent will appear. 4. As an emergency measure, the Contracting Authority permits communication by email. The email address of the person authorized to contact Contractors is: zamowienia@pomorskie.eu (this does not apply to the submission of tenders with attachments). 5. The Contracting Authority will provide information to Contractors electronically via the Purchasing Platform. Information, notices, changes, and replies will be posted by the Contracting Authority on the Purchasing Platform. Correspondence that, pursuant to the applicable regulations, is addressed to a specific Contractor will be transmitted electronically via the Purchasing Platform to that specific Contractor at the email address indicated in the Contractor’s tender. 6. As a professional entity, the Contractor is obliged to check communications and messages sent by the Contracting Authority directly on the Purchasing Platform and by email—at the address indicated in the tender—because the notification system may malfunction or a notification may be delivered to the SPAM folder. 7. The Contracting Authority specifies the necessary technical requirements enabling use of the Purchasing Platform, i.e.: 1) an internet connection with a bandwidth of at least 2 Mbit/s; 2) the EDGE, Chrome, or FireFox web browser in the latest available version, with Javascript enabled, accepting “cookies” or permitting the use of the browser’s local storage. platformazakupowa.pl is optimized for a minimum screen resolution of 1280x768 pixels. Furthermore, the Contracting Authority informs that a limit applies to the volume of files or compressed folders for the entire tender or request: 10 files or compressed folders (files may be compressed using archiving software, e.g. 7-Zip), with a maximum size of 150 MB for each file. 8. By participating in this public procurement procedure, the Contractor: 1) accepts the terms and conditions for using the Purchasing Platform specified in the Rules posted on the Platform’s website via the link in the “Rules” tab and acknowledges them as binding, 2) has read and complies with the current Instructions for submitting tenders/requests available at: https://platformazakupowa.pl/strona/45-instrukcje. 9. The Contracting Authority shall not be liable for the submission of a tender in a manner inconsistent with the Instructions for using the Purchasing Platform, particularly in a situation where the contracting authority becomes acquainted with the contents of the tender before the tender submission deadline (e.g. submission of the tender in the “Send a message to the contracting authority” tab). Such a tender will be regarded by the Contracting Authority as a commercial offer and will not be considered in this procedure because the obligation imposed by Art. 221 of the Pzp Act has not been fulfilled. 10. The Contracting Authority informs that instructions for using the Purchasing Platform, concerning in particular logging in, submitting requests for clarification of the contents of the SWZ, submitting tenders, and performing other actions in this procedure using the Purchasing Platform, are available in the “Instructions for Contractors” tab on the website at: https://platformazakupowa.pl/strona/45-instrukcje. Other information contained on the Platform that does not concern its technical use is not binding on Contractors. 11. With respect to matters not regulated by this SWZ, the provisions of the Pzp Act and the Regulation of the President of the Council of Ministers of 30 December 2020 on the method of preparing and transmitting information and the technical requirements for electronic documents and electronic means of communication in a public procurement procedure or competition shall apply. 1. The subject matter of the contract is the provision of training courses for employees of educational institutions and public administration to enhance intercultural competences. The training courses will be held in connection with implementation of the “Pomorskie Welcome Center” project, co-financed by the European Union and implemented under the Asylum, Migration and Integration Fund 2021-2027, Specific Objective 2—Legal migration and integration. 2. A detailed description of the subject matter of the contract is set out in Appendix No. 1 to the SWZ and in the draft contract, which constitutes Appendix No. 2 to the SWZ. 3. The law applicable to this contract (including the contract concluded as a result of this procedure and the assessment of the legal effects of all documents in this procurement) is Polish law, taking into account European Union law. 4. In all provisions of the SWZ and its appendices in which the Contracting Authority refers to standards, approvals, technical specifications, or reference systems, or in which trademarks, parameters, or sources of origin (names of manufacturers or equipment) are indicated, pursuant to Art. 99(5) and Art. 101(4) of the Pzp Act, the Contracting Authority permits equivalent solutions. 5. Where the description of the subject matter of the contract provides the names of materials or products of specific manufacturers, this should be treated solely as an indication of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials or products with at least the same technical and quality parameters. Product equivalence shall mean offering a product whose technical parameters of the materials used, performance, durability, and quality are no worse than the quality of the materials and products described in the SWZ. 6. A Contractor relying on equivalent solutions is obliged to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 7. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. The Contractor may entrust performance of part of the contract to a Subcontractor. 8. Subcontracting: 1) The Contractor may entrust performance of part of the contract to a subcontractor (subcontractors). 2) In connection with performance of the contract, the Contracting Authority does not reserve the obligation to personally perform the contract’s key tasks. 3) The Contracting Authority requires that, where part of the contract is entrusted to subcontractors, the contractor indicate in the tender the parts of the contract it intends to entrust to subcontractors and provide the names of those subcontractors (if already known). 4) Entrusting parts of the contract to subcontractors does not release the contractor from liability for due performance of the contract. 9. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to the Contractors referred to in Art. 94 of the Pzp Act. 10. Acting pursuant to Art. 95(1) and (2) of the Act, the Contracting Authority informs that it requires the Contractor or subcontractor(s) to employ, under an employment relationship, persons performing activities within the scope of contract performance that consist of performing work in the manner specified in Art. 22 § 1 of the Act of 26 June 1974—the Labour Code. Detailed information in this regard is contained in Chapter IV of the SWZ. 11. The Contracting Authority does not provide for an obligation for the Contractor to conduct a site visit or for the Contractor to inspect documents necessary for performance of the contract that are available at the Contracting Authority’s premises. 12. The Contracting Authority does not permit the submission of a variant tender referred to in Art. 92 of the Pzp Act, i.e. a tender providing for a method of performing the contract different from that specified in this SWZ. 13. The Contracting Authority does not provide for the conclusion of a framework agreement or the establishment of a dynamic purchasing system, nor does it provide for selection of the most advantageous tender using an electronic auction. 14. The Contracting Authority does not provide for the award of contracts pursuant to Art. 214(1)(7) of the Pzp Act. 15. The Contracting Authority does not permit the submission of a tender in the form of electronic catalogues or the attachment of electronic catalogues to the tender in the situation specified in Art. 93 of the Pzp Act. 16. The Contracting Authority does not provide for settlement in foreign currencies. Settlement of the contract will be conducted in PLN. 17. The Contracting Authority does not provide for reimbursement of the costs of participation in the procedure. 18. The Contracting Authority does not provide for the granting of advance payments toward performance of the contract. 19. The Contracting Authority does not permit the submission of tenders for parts. 20. Justification for not dividing the contract into parts: The contract has not been divided into parts due to the nature and subject matter of the contract, which covers the comprehensive organization of training courses for employees of educational institutions and public administration to enhance intercultural competences. Organization of the training courses by a single Contractor will ensure the same level of service throughout the entire term of the contract and will significantly accelerate the communication process between the Contractor and the Contracting Authority, i.e. the process of agreeing upon and approving conditions/deadlines. The absence of a division of this contract into parts does not violate the principle of competition. The size and value of the contract do not constitute a barrier to access for small and medium-sized enterprises.
