Opportunity description

Description of the subject matter of the contract: a) The subject matter of the contract is a service consisting in the modernization of the public lighting system together with the installation of smart services in the City of Kraków. b) The contract is divided into 2 parts: Smart - Modernization of the public lighting system together with the installation of smart services in the City of Kraków - Part I. Smart - Modernization of the public lighting system together with the installation of smart services in the City of Kraków - Part II. c) The Contracting Authority described the Subject matter of the contract by means of the following annexes to the SWZ: - Draft contractual provisions (PPU), constituting Annex No. 2.1 for Part No. 1; - Draft contractual provisions (PPU), constituting Annex No. 2.2 for Part No. 2; - Scope of work with annexes, constituting Annex No. 6.1 for Part No. 1; - Scope of work with annexes, constituting Annex No. 6.2 for Part No. 2; - Price table (tender price list), constituting Annex No. 7.1 for Part No. 1; - Price table (tender price list), constituting Annex No. 7.2 for Part No. 2; d) Required warranty period: The minimum warranty period is 120 months. The maximum warranty period is 144 months. Tenders containing a warranty period shorter than 120 months will be rejected. e) If any annex to the SWZ contains manufacturers’ names, trademarks, standards, approvals, technical specifications or reference systems, the products may be replaced with equivalent products. The Contracting Authority will consider as equivalent solutions those solutions that make it possible to achieve the effect intended by the Contracting Authority using other technical solutions. An identical (the same) solution cannot be considered an equivalent solution; only one which, in the compared characteristics, demonstrates exactly the same or a very similar utility value may be considered equivalent. By indicating manufacturers’ names, trademarks, standards, approvals or reference systems, the Contracting Authority intended to specify the minimum quality parameters and functional characteristics that the goods must meet in order to satisfy the requirements set by the Contracting Authority, and these constitute solely a quality benchmark for the subject matter of the contract. By the provision concerning minimum quality parameter requirements, the Contracting Authority understands the requirements for goods contained in generally available sources, catalogs, manufacturers’ websites, and the like. The use of example manufacturers’ names is intended solely to clarify the level of the Contracting Authority’s expectations with respect to a specific solution f) Contract performance period: Part 1- 26 months from the date of conclusion of the contract, Part 2 - 12 months from the date of conclusion of the contract g) The Contracting Authority, pursuant to Art. 95 sec. 1 of the PZP Act, requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the activities indicated below: a) manual workers– direct performance of services Note! h) The Contracting Authority permits the contract to be performed personally by persons conducting business activity or partners/shareholders of a commercial-law company. i) The Contracting Authority, pursuant to Art. 106 sec. 1 of the Pzp Act, requires the contractor to attach to the tender product-related evidence, i.e. the Contracting Authority will require the tender to include data sheets for the luminaires intended for installation and the ENEC, ENEC+, ZHAGA D4i certificates issued for them, LM-79 and LM-80 reports, and CE declarations (all required evidence must be submitted in Polish). Note!!! Pursuant to Art. 226 sec. 1 point 2) letter c), failure to submit the product-related evidence constitutes grounds for rejecting the contractor’s tender. For the avoidance of doubt, ENEC Certificates for stylized LED luminaires in areas under strict conservation protection do not constitute product-related evidence required with the tender (ENEC Certificates for the type of luminaires in question must be submitted to the Contracting Authority as part of material approval before their installation and after first obtaining a positive opinion from the Heritage Conservator regarding the style of the luminaires). In the case of stylized LED luminaires, only their data sheets must be submitted with the tender (also confirming the possibility of equipping them with a low-voltage Zhaga socket compliant with D4i standardization.). The Contracting Authority will require the tender to include a Zhaga-D4i Certificate for the offered controllers, an ENEC Certificate for the offered controllers, and a TALQ Certificate for the offered controllers communicating with the server (applies to all types of luminaires). The Contracting Authority will require the tender to include a TALQ Certificate for the offered CMS.” 1.
