Opportunity description

1. The subject matter of the contract is the supply of electricity within the meaning of the Energy Law Act (Journal of Laws 2022.1385, consolidated text of 2022.07.01), hereinafter referred to as the sale of electricity, in an estimated quantity of 3 305 829 kWh for existing consumption points and consumption points planned for connection, specified in Appendix No. 1 to the SWZ, during the period from 01.01.2027 to 31.12.2027, in accordance with the conditions contained in these Terms of Reference, hereinafter referred to as the “SWZ”. 2. The list of consumption points, which describes the data identifying the electricity consumption points (hereinafter PPE), is contained in Appendix No. 1 to the SWZ. 3. The sale of electricity will be carried out under the conditions specified in the Energy Law Act of 10 April 1997 (consolidated text: Journal of Laws 2024.266, as amended), the implementing regulations for that Act, in particular the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system, the currently applicable tariff for electricity distribution services of the competent Distribution System Operator (OSD), approved by the President of the Energy Regulatory Office, the Distribution Network Operation and Maintenance Instructions, generally applicable legal provisions, and the unit prices of active energy determined following the conclusion of the procedure in question. 4. Note! The estimated quantity of energy ordered has been determined on the basis of consumption in 2025 and is merely indicative, serving to compare tenders; under no circumstances does it constitute a commitment on the part of the Contracting Authority to purchase energy in the stated quantity. The Contractor will not be entitled to any claim against the Contracting Authority due to the failure to consume the anticipated quantity of energy. The Contracting Authority will pay for the quantity actually consumed. 3.1 The contract award procedure is conducted in Polish. 3.2 In the contract award procedure, communication between the Contracting Authority and the Contractors takes place using the platform available at: https://platformazakupowa.pl/ or by email: przetargi@dorzeczebialej.pl, provided that the tender must be submitted solely and exclusively via the platform https://platformazakupowa.pl/. 3.3 In the contract award procedure, communication between the Contracting Authority and the Contractors takes place using platformazakupowa.pl, unless otherwise stated in the Contract Notice, the Terms of Reference (SWZ), or the invitation to submit tenders. 3.4 The link to the procedure is available on the details are provided in the Contract Notice, the SWZ, or the invitation to submit tenders. 3.6 The technical and organisational requirements are described in the Rules and Regulations of www.platformazakupowa.pl, which supplement these Instructions. 3.7 There is a volume limit for files or compressed folders for the entire tender or request of 10 files or compressed folders (files may be compressed in accordance with section 3.10), with a maximum size of 150 MB. 3.8 For large files, the internet connection and the available connection bandwidth on the side of the www.platformazakupowa.pl server and the user are crucial. 3.9 When submitting a tender, it is recommended to plan its submission at least 24h in advance in order to meet the submission deadline in the event of force majeure, such as a www.platformazakupowa.pl failure, an internet failure, technical problems related to the lack of, for example, an up-to-date browser, etc. 3.10 For larger files, we recommend using the file compression instructions, dividing them into smaller packages of, for example, 150 MB each (https://docs.google.com/document/d/1SeGipoISZzhgZ-dXiyupE6M11fAFcqE-iUTMFwSL5UQ/edit#). 3.11 The date of submission of a tender or requests is deemed to be the date on which they are transmitted in the system by clicking the Submit tender button in the second step and when a message is displayed stating that the tender has been submitted. 3.12 The time displayed on platformazakupowa.pl is automatically synchronised with the server of the Central Office of Measures. 3.13 Oral communication is permitted only in relation to information that is not material, in particular information that does not concern the Contract Notice or procurement documents or tenders. 3.14 Tenders, statements referred to in Article 125(1) of the Act, entity-related means of proof, including the statement referred to in Article 117(4) of the Act, and the commitment of the entity making resources available referred to in Article 118(3) of the Act, hereinafter referred to as the commitment of the entity making resources available", subject-matter means of proof, and powers of attorney shall be prepared in electronic form, in the data formats specified in the regulations issued pursuant to Article 18 of the Act of 17 February 2005 on the computerisation of the activities of entities performing public tasks (Journal of Laws of 2020, items 346, 568, 695, 1517 and 2320), subject to the formats referred to in Article 66(1) of the Act and taking into account the type of data transmitted. 3.15 Information, statements, or documents other than those specified in section 3.14 of this chapter of the SWZ, transmitted in the contract award procedure, shall be prepared in a form compliant with the Regulation of the President of the Council of Ministers of 30 December 2020 on the method of preparing and transmitting information and the technical requirements for electronic documents and electronic means of communication in a public procurement or design contest procedure, or as text entered directly into a message transmitted using the electronic means of communication indicated by the Contracting Authority in this SWZ. 3.16 Where electronic documents in the contract award procedure, transmitted using electronic means of communication, contain information constituting a trade secret within the meaning of the provisions of the Act of 16 April 1993 on combating unfair competition (Journal of Laws of 2020, item 1913), the Contractor, in order to maintain the confidentiality of this information, shall transmit it in a separate, appropriately marked file. 3.17 Entity-related means of proof, subject-matter means of proof, and other documents or statements prepared in a foreign language shall be transmitted together with a translation into Polish. 3.18 The
