Opportunity description
1. The subject matter of the contract is the supply of electricity to the State Administration Units indicated in Annex No. 1 to the SWZ. 2. Detailed lists of electricity consumption points (PPE) belonging to the State Administration Units constitute separate files in Excel format (entitled Wykazy PPE.zip). 3. The planned estimated quantity of electricity for the individual tariff groups has been indicated in the Tender Form constituting Annex No. 3 to the SWZ and constitutes the total quantity of energy for all Units covered by this contract. 4. The planned estimated quantity of energy was determined on the basis of the planned needs of the State Administration Units, including on the basis of the electricity consumption indicated in the PPE lists. 5. The detailed method of performance of the subject matter of the contract has been specified in Annex No. 4 to the SWZ, constituting the Draft contractual provisions. 6. The Contracting Authority provides for an option right regarding the additional purchase of energy. The additional purchase of the subject matter of the contract (energy supply) under the option right may not exceed 5% of the value of the basic contract (in total across all tariffs). Detailed conditions concerning the option right have been specified in §4 of Annex No. 4 to the SWZ, constituting the Draft contractual provisions. 7. The Contracting Authority may cancel the contract award procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 8. The Contracting Authority informs that the contract for the needs of: 1) the Ministry of State Assets will be co-financed from the European Regional Development Fund under Technical Assistance for European Funds 2021-2027; 2) the Ministry of National Education will be co-financed from the European Social Fund Plus under the European Funds for Social Development programme. (Project No. FERS.06.01-IZ.00-0009/23 “FERS Technical Assistance for the Ministry of National Education for the years 2024- 2029”); 3) the Ministry of Development Funds and Regional Policy will be co-financed from European Union funds from the Cohesion Fund under the Technical Assistance for European Funds Programme for the years 2021-2027; 4) the Ministry of Climate and Environment will be co-financed under the programmes: European Fund for Eastern Poland, European Fund for Infrastructure, Climate, Environment; 5) the Ministry of Family, Labour and Regional Policy will be co-financed from Technical Assistance for FERS; 6) the Ministry of Health will be co-financed from the European Social Fund Plus under the European Funds for Social Development Programme 2021-2027 and from the Cohesion Fund under the European Funds for Infrastructure, Climate, Environment Programme 2021-2027; 7) the Provincial Building Supervision Inspectorate in Kraków will be co-financed under the European Funds for Infrastructure, Climate, Environment Programme 2021-2027 (FEnIKS). 9. The Contracting Authority does not provide for the award of contracts referred to in Art. 214(1)(8) of the Pzp Act. 10. The Contracting Authority does not provide for conducting the electronic auction referred to in Art. 227 - 238 of the Pzp Act. 11. The Contracting Authority does not permit the submission of variant tenders within the meaning of Art. 92(1) of the Pzp Act. 12. The Contracting Authority does not provide for concluding the framework agreement referred to in Art. 311 - 315 of the Pzp Act. 13. The Contracting Authority does not provide for reimbursement of the costs of participation in the procedure, including reimbursement of costs incurred for obtaining a qualified electronic signature. 14. The Contracting Authority does not permit tenders to be submitted in the form of electronic catalogues or electronic catalogues to be attached to the tender. 15. The Contracting Authorities are the State Administration Units listed in Annex No. 1 to the SWZ, in whose name and on whose behalf the Central Contracting Authority - Government Administration Service Centre, ul. Powsińska 69/71, 02-903 Warszawa, acts as the entity conducting the public contract award procedure. 16. All other requirements not included in this notice are contained in the SWZ and the annexes to the SWZ. 1. The supply of electricity will take place on the basis of separate sales contracts concluded by the Contracting Authority with the Contractor for each of the Units. The condition for commencing supplies to a given electricity consumption point is: 1) the Unit's successful completion of the supplier switching procedure, i.e. completion of all formalities related to switching supplier and necessary for the performance of energy supplies, 2) the Unit's adaptation of metering systems to the TPA principle (if such a change is necessary), 3) conclusion of separate distribution contracts by the Units (if such contracts have not been concluded by the Units), 4) expiry or effective termination of the currently applicable electricity sales contracts or comprehensive service contracts. 7. The Contracting Authority provides for an option right regarding the additional purchase of energy.
