Opportunity description

The procedure is conducted as an open tender pursuant to Art. 132 of the Public Procurement Law, in which all interested contractors may submit tenders in response to the contract notice. 1. The contracting authorities described in Chapter I of the SWZ jointly conduct the public procurement procedure (Art. 38 of the Public Procurement Law); the authorised Contracting Authority – Leader of the Purchasing Group is the Municipality of Nieszawa. 2. The subject of the contract is the supply of electricity in the period from 01.01.2027 to 31.12.2028. 3. CPV code: 09300000-2 - Electricity, heating, solar and nuclear energy 09310000-5 – Electricity 4. The contract will be awarded in two parts. The contractor may submit a tender for any number of parts 1) Part 1 of the contract – Supply of electricity to premises and facilities 2) Part 2 of the contract – Supply of electricity for road lighting needs A detailed description of the individual parts of the contract is provided in Chapters III.1 and III.2 of the SWZ. 5. The data concerning the quantity of electricity to be purchased are indicative. The quantity of electricity was estimated on the basis of historical electricity consumption data for a period of 12 months, taking into account planned changes in use and actions undertaken by the contracting authorities referred to in Art. 37 of the Act of 7 October 2022 on special solutions serving to protect electricity consumers in 2023 and 2024 in connection with the situation on the electricity market, as well as the estimated quantity of electricity generated in generating installations. The contractor should take into account possible fluctuations in electricity consumption. A decrease or increase in the quantity of electricity shall have no consequences for the contracting authorities (consumers), apart from the obligation to pay for the quantity of energy actually consumed. The indicated estimated quantity of energy is the quantity that the contracting authorities intend to purchase, taking into account the quantity of electricity generated on their own and consumed as part of self-consumption. 6. Quality standards 1) The subject of the contract is the supply of electricity meeting the quality standards specified in accordance with the applicable regulations. 2) Electricity quality standards are described in the Energy Law Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (consolidated text, Journal of Laws 2025, item 919, as amended). 3) The rules for setting and calculating tariffs and for settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of setting and calculating tariffs and the method of settlements in electricity trading (consolidated text, Journal of Laws 2024, item 904, as amended). 7. Details concerning electricity consumption are described in Appendices No. 1a and 1b to the SWZ, List of Consumption Points. 8. Applicable settlement periods: Customarily applied settlement periods (the contracting authority does not have detailed data for individual PPEs) Tariff group Bx, C2x – 1 month Tariff group C1x, G, R – 2 months. 9. On the basis of the granted Power of Attorney, the contractor will be obliged to notify the relevant DSO of the agreement on its own behalf and on behalf of the contracting authority (consumers), in accordance with the applicable regulations, and to represent it before the DSO in the process of changing the supplier. 10. Distribution services are/will be provided on the basis of separate agreements concluded between the contracting authorities (electricity consumers) and the DSO. 11. Distribution system operator – in accordance with the description in Appendices No. 1a and 1b to the SWZ, column “Distribution System Operator”. 12. The condition for commencing electricity supplies on the indicated date (with respect to individual consumption points) is the successful completion of the supplier change procedure, the Consumer having a valid agreement for the provision of electricity distribution services, registration of the changes made by the DSO, and effective termination/expiry of the currently applicable electricity sale agreements/comprehensive agreements: 1) In the case of agreements requiring termination, the contracting authorities (consumers) will submit (with respect to individual consumption points) appropriate statements terminating the agreements with effect on the day preceding the planned supply commencement date (in accordance with the description in Appendix No. 1a / 1b to the SWZ, column “Supply Period”) - termination of the agreements will not be among the contractor’s obligations. 2) In the case of fixed-term sales agreements, their term expires on the day preceding the planned supply commencement date (in accordance with the description in Appendix No. 1a / 1b to the SWZ, column “Supply Period”). 13. In the case of consumption points where the sales and distribution agreements have already been separated (subsequent supplier change), the contracting authorities (consumers) have distribution agreements concluded for an indefinite period. 14. In the case of consumption points for which the supplier will be changed for the first time (and comprehensive agreements are currently in force), the contractor will be authorised by the contracting authority to: 1) submit applications for the conclusion of distribution agreements for an indefinite period 2) conclude, in the name and on behalf of the principal, agreements for the provision of electricity distribution services for an indefinite period. 15. If, during the term of the agreement, changes occur concerning the Buyer / Consumer that require the conclusion of a new distribution agreement, the contracting authority may grant the contractor an appropriate Power of Attorney or conclude the agreement individually. 16. The procedure does not cover PPEs (tariff group G) where electricity will be intended for household purposes. 17. The procedure does not cover PPEs that will have Prosumer status during the contract performance period. 18. The contractor will be obliged to prepare and provide the contracting authorities (Parties to the agreement) with a List of invoices issued, separately for 2027 and 2028. 1. The subject of the contract is the supply of electricity with an estimated volume (basic contract) of 13 695,39 MWh. The data are indicative. 2. Number of metering systems accounting for consumed electricity: 519 units. 3. The metering systems are adapted to the supplier change procedure. 4. The contracting authority has provided a detailed description of the consumption points (PPE) in Appendix No. 1a to the SWZ. 5. Supplies will be carried out from 01.01.2027 to 31.12.2028; details concerning the supply dates for individual consumption points are described in Appendix No. 1a to the SWZ, column “Supply Period”. 6. The currently applicable electricity supply agreements will expire or be terminated with effect on the day preceding the planned supply commencement date (column “Supply Period”). The obligation to terminate the agreements rests with the contracting authorities (consumers). 7. Generation sources: 1) Details concerning PV installations at the facilities covered by the procedure (including capacity, connection date or planned connection date, expected quantity of energy fed into the DSO grid, consumer status) are provided in Appendix 1a to the SWZ – column “Generating Installation”. 2) Where it is planned to feed surplus energy into the DSO grid, the contracting authorities consent to the conclusion of an agreement/agreements for the repurchase and balancing of energy based on the template used by the contractor, subject to the following provisos: a) the contracting authority (Consumer) will not be charged by the contractor any additional costs for concluding the repurchase agreement (e.g. commercial / subscription fee), b) the repurchase price (after taking into account the contractor’s margin and operating costs, including balancing costs) shall have a positive value; if the electricity repurchase price, according to the formula used by the contractor, has a negative value, a value of PLN 0,00 shall be used for settlement. 3) The contracting authorities (Consumers) do not have any other RES installations generating electricity at the reported facilities. 1. The subject of the contract is the supply of electricity with an estimated volume of 8 450,74 MWh. The data are indicative. 2. Number of metering systems accounting for consumed electricity: 1 255 units. 3. The contracting authority has provided a detailed description of the consumption points (PPE) in Appendix No. 1b to the SWZ. 4. Supplies will be carried out from 01.01.2027 to 31.12.2028; details concerning the supply dates for individual consumption points are described in Appendix No. 1b to the SWZ, column “Supply Period”. 5. The currently applicable electricity supply agreements will expire or be terminated with effect on the day preceding the planned supply commencement date (column “Supply Period”).
