Opportunity description

1. The contracting authorities described in Chapter I of the SWZ are jointly conducting a public procurement procedure (Article 38 of the Public Procurement Law), and the authorised Contracting Authority – Leader of the Purchasing Group is the Municipality of Kwidzyn. 2. The subject matter of the contract is the supply of electricity in the period from 01.01.2027 to 31.12.2027 together with a balancing service. 3. The contract will be awarded in two parts. The contractor may submit a tender for any number of parts: 1) Part 1 of the contract – Supply of electricity to premises and facilities, 2) Part 2 of the contract – Supply of electricity for road lighting purposes. A detailed description of the individual parts of the contract is provided in Chapters III.1 and III.2 of the SWZ. 4. The data concerning the quantity of electricity to be purchased are indicative. The quantity of electricity was estimated on the basis of historical electricity consumption data, taking into account projected changes in use and the measures taken by the contracting authorities referred to in Article 37 of the Act of 07 October 2022 on special solutions serving to protect electricity consumers in 2023 and 2024 in connection with the situation on the electricity market, as well as the estimated quantity of electricity generated in generating installations. The contractor should take into account possible fluctuations in electricity consumption. A decrease or increase in the quantity of electricity will not entail any consequences for the contracting authorities (consumers), apart from the obligation to pay for the quantity of energy actually consumed. The indicated estimated quantity of energy is the quantity that the contracting authorities intend to purchase and does not include energy generated independently and consumed through self-consumption. 5. Quality standards: 1) The subject matter of the contract is the supply of electricity with quality standards specified in accordance with the applicable regulations. 2) Electricity quality standards are described in the Energy Law Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the electricity system (consolidated text: Journal of Laws 2025, item 919). The rules for establishing and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of establishing and calculating tariffs and the method of settlements in electricity trading (Journal of Laws 2024, item 904, as amended). 6. On the basis of the Power of Attorney granted, the contractor will be obliged to notify the relevant DSO of the agreement, on its own behalf and on behalf of the contracting authority (consumers), in accordance with the applicable regulations, and to represent it before the DSO in the supplier-switching process. 7. Distribution services are/will be provided on the basis of separate agreements concluded between the contracting authorities (electricity consumers) and the DSO. 8. In Annex No 1a/1b to the SWZ, the “Supplier switch” column indicates for which PPE the supplier switch will take place for the first time and for which it will take place again. 9. The procedure does not cover PPE where electricity will be intended for household purposes (tariff group G). 10. The contracting authority will apply Article 139(1) of the Public Procurement Law, i.e. it will first examine and evaluate the tenders and then perform the qualitative selection of the contractor whose tender received the highest score with respect to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 11. The contracting authority specifies the contract performance period by indicating a specific start and end date for contract performance due to the need to maintain continuity of energy supplies to the individual consumption points and due to the provisions of the DSO’s IRiESD (Distribution Network Operation and Maintenance Instructions) concerning the supplier-switching procedure, in particular the provisions concerning the deadline for notifying the commencement of supplies and the obligation to notify the supply end date. Agreements concluded as a result of the procedure will take effect on the date of their conclusion/signing by the Parties. 1. The subject matter of the contract is the supply of electricity with an estimated volume of 3 464,48 MWh. The consumption data are indicative. 2. Number of metering systems measuring consumed electricity: 390 units. 3. The contracting authority has provided a detailed description of the consumption points (PPE) in Annex No 1a to the SWZ. 4. Supplies will be provided from 01.01.2027 to 31.12.2027; details concerning the supply periods for the individual consumption points are described in Annex No 1a to the SWZ, in the “Supply period” column. 5. The metering systems are adapted to the supplier-switching procedure. 6. Generating sources: 1) Details concerning PV installations at the facilities covered by the procedure (including capacity, connection date or planned connection date, expected quantity of energy fed into the DSO network, and consumer status) are provided in Annex 1a to the SWZ – the “Generating installation” column. 2) Where it is planned to feed surplus energy into the DSO network, the contracting authorities consent to concluding an agreement for the repurchase and balancing of energy based on the template used by the contractor, subject to the following reservations: a) the contracting authority (Consumer) will not be charged additional costs by the contractor for concluding the repurchase agreement (e.g. a commercial/subscription fee), b) the repurchase price (after taking into account the contractor’s margin and operating costs) will have a positive value; where the electricity repurchase price, calculated using the formula applied by the contractor, has a negative value, a value of PLN 0,00 will be used for settlement. 3) The contracting authority, the Municipality of Kwidzyn, has blockers installed in relation to 5 PPE that prevent electricity from being fed into the network. 4) The contracting authorities (Consumers) are not entered in the MIOZE register. 5) The contracting authorities (Consumers) do not have any other RES installations generating electricity. 7. The currently applicable agreements for the supply of electricity/comprehensive supply of electricity will expire or be terminated with effect on the day preceding the planned supply commencement date (the “Supply period” column). The obligation to terminate the agreements rests with the contracting authorities (consumers). 1. The subject matter of the contract is the supply of electricity with an estimated volume of 708,07 MWh. The data are indicative. 2. Number of metering systems measuring consumed electricity: 109 units. 3. The contracting authority has provided a detailed description of the consumption points (PPE) in Annex No 1b to the SWZ. 4. Supplies will be provided from 01.01.2027 to 31.12.2027; details concerning the supply periods for the individual consumption points are described in Annex No 1b to the SWZ, in the “Supply period” column. 5. The currently applicable agreements for the supply of electricity/comprehensive supply of electricity will expire or be terminated with effect on the day preceding the planned supply commencement date (the “Supply period” column). The obligation to terminate the agreements rests with the contracting authorities (consumers). Procedure: open.
