Opportunity description
1. The Contracting Authorities described in Chapter I of the SWZ are jointly conducting a public procurement procedure (Article 38 of the Public Procurement Law), with the authorised Contracting Authority – the Leader of the Purchasing Group, the Municipality of Świecie, acting through an Attorney-in-Fact. 2. The subject matter of the contract is the supply and comprehensive supply of electricity in the period from 01.01.2027 to 31.12.2027. The contract will be awarded in four parts. The Contractor may submit a tender for any number of parts: 1) Part 1 of the contract – Supply of electricity to premises and facilities – other tariff groups 2) Part 2 of the contract – Supply of electricity to premises and facilities – tariff group B 3) Part 3 of the contract – Supply of electricity for road lighting purposes 4) Part 4 of the contract – Comprehensive supply of electricity – Prosumers. A detailed description of the individual parts of the contract is provided in Chapters III.1, III.2, III.3 and III.4 of the SWZ. 3. The data concerning the quantity of electricity to be purchased are indicative. The quantity of electricity was estimated on the basis of historical electricity consumption data, taking into account planned changes in use and actions taken by the Contracting Authorities referred to in Article 37 of the Act of 7 October 2022 on special solutions serving to protect electricity consumers in 2023 and 2024 in connection with the situation on the electricity market, as well as the estimated quantity of electricity generated in generating installations. The Contractor should take into account possible fluctuations in electricity consumption. A decrease or increase in the quantity of electricity shall have no consequences for the Contracting Authorities (consumers), apart from the obligation to pay for the quantity of energy actually consumed and transmission services in accordance with the applicable DSO Tariff. The indicated estimated quantity of energy is the quantity that the Contracting Authorities intend to purchase, taking into account the quantity of electricity generated in-house and consumed through self-consumption. 4. Quality standards: 1) The subject matter of the contract is the supply of electricity meeting the quality standards specified in the applicable regulations. 2) Electricity quality standards are described in the Energy Law Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the electricity system (consolidated text: Journal of Laws 2025, item 919). The principles for setting and calculating tariffs and for settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of setting and calculating tariffs and the method of settlement in electricity trading (Journal of Laws 2024, item 904, as amended). 3) Standards concerning electricity distribution are contained in the Operator’s Tariff. 5. On the basis of the granted Power of Attorney, the Contractor will be required to notify the relevant DSO of the agreement on its own behalf and on behalf of the Contracting Authority (consumers), in accordance with the applicable regulations, and to represent it before the DSO during the supplier-switching process. 6. The procedure does not cover PPEs (tariff group G) in which electricity will be used for household purposes. 7. The Contracting Authority will apply Article 139(1) of the Public Procurement Law, i.e. it will first examine and evaluate the tenders and then perform the qualitative selection of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 8. The Contracting Authority specifies the contract performance period by indicating a specific commencement and completion date due to the need to maintain continuity of energy supply to individual consumption points and due to the DSO’s IRiESD (Distribution Network Operation and Maintenance Instructions) provisions concerning the supplier-switching procedure, in particular the provisions concerning the deadline for notifying the commencement of supply and the obligation to notify the supply completion date. 9. Agreements concluded as a result of the conducted procedure will be effective from the date of their conclusion/signing by the Parties. 1. The subject matter of the contract is the supply of electricity with an estimated volume of 5 952,23 MWh. The data are indicative. 2. Number of metering systems measuring the electricity consumed: 532 units. 3. The metering systems are adapted to the supplier-switching procedure. 4. The Contracting Authority has provided a detailed description of the consumption points (PPE) in Appendix No 1a to the SWZ. 5. The currently applicable electricity supply agreements will expire or be terminated with effect on the day preceding the planned supply commencement date (column “Supply period”). The obligation to terminate the agreements rests with the Contracting Authorities (consumers). 6. Generating sources: 1) Details concerning PV installations at the facilities covered by the procedure (including capacity, connection date or planned connection date, expected quantity of energy fed into the DSO network, and consumer status) are provided in Appendix 1a to the SWZ – column “PV installation”. 2) Where surplus energy is planned to be fed into the DSO network, the Contracting Authorities consent to concluding an agreement/agreements for the repurchase and balancing of energy using the Contractor’s template, subject to the following reservations: a) the Contracting Authority (Consumer) will not be charged any additional costs by the Contractor for concluding the repurchase agreement (e.g. commercial/subscription fee), b) the repurchase price (after taking into account the Contractor’s margin and operating costs, including balancing costs) shall have a positive value; where the electricity repurchase price calculated using the Contractor’s formula has a negative value, the value of PLN 0,00 shall be used for settlement purposes. 3) The Contracting Authorities (Consumers) do not have any other renewable energy installations generating electricity at the reported facilities. 1. The subject matter of the contract is the supply of electricity with an estimated volume of 2 224,32 MWh. The data are indicative. 2. Number of metering systems measuring the electricity consumed: 8 units. 3. The metering systems are adapted to the supplier-switching procedure. 4. The Contracting Authority has provided a detailed description of the consumption points (PPE) in Appendix No 1b to the SWZ. 5. The currently applicable electricity supply agreements will expire or be terminated with effect on the day preceding the planned supply commencement date (column “Supply period”). 6. For all PPEs, this will be a subsequent supplier switch. 7. Generating sources: 1) Details concerning PV installations at the facilities covered by the procedure (including capacity, connection date, expected quantity of energy fed into the DSO network, and consumer status) are provided in Appendix 1b to the SWZ – column “PV installation”. 2) Where surplus energy is planned to be fed into the DSO network, the Contracting Authorities consent to concluding an agreement/agreements for the repurchase and balancing of energy using the Contractor’s template, subject to the following reservations: a) the Contracting Authority (Consumer) will not be charged any additional costs by the Contractor for concluding the repurchase agreement (e.g. commercial/subscription fee), b) the repurchase price (after taking into account the Contractor’s margin and operating costs, including balancing costs) shall have a positive value; where the electricity repurchase price calculated using the Contractor’s formula has a negative value, the value of PLN 0,00 shall be used for settlement purposes. 3) The Contracting Authorities (Consumers) do not have any other renewable energy installations generating electricity at the reported facilities. 1. The subject matter of the contract is the supply of electricity with an estimated volume of 3 601,05 MWh. The data are indicative. 2. Number of metering systems measuring the electricity consumed: 633 units. 3. The Contracting Authority has provided a detailed description of the consumption points (PPE) in Appendix No 1c to the SWZ. 4. The currently applicable electricity supply agreements will expire or be terminated with effect on the day preceding the planned supply commencement date (column “Supply period”). The obligation to terminate the agreements rests with the Contracting Authorities (consumers). 1. The subject matter of the contract is the comprehensive supply of electricity – supply together with a distribution service, with an estimated volume of 1 155,82 MWh, and the settlement and balancing of electricity fed into the network by Prosumers. The volume data are indicative. 2. Number of metering systems measuring the electricity consumed: 26 units. 3. The Contracting Authority has provided a detailed description of the consumption points (PPE) in Appendix No 1d to the SWZ. 4. PV micro-installations are installed at all PPEs. 5. At all PPEs, the consumers have Prosumer status and settle under the net-billing and net-metering systems – in accordance with the description in Appendix 1d, column “Status”. 6. For all PPEs, the Contracting Authorities have concluded comprehensive agreements. 7. As a result of the award of Part 4 of the contract, agreements will be concluded according to the template constituting Appendix No 9b to the SWZ; however, the Contracting Authority permits the introduction of changes arising in particular from requirements related to the settlement of energy fed into the DSO network. The Contracting Authority permits the conclusion of an Agreement using the Contractor’s template, subject to the following reservations: 1) The provisions of the Draft contractual provisions – Appendix No 9b to the SWZ – will be included. 2) The Contractor’s template will not contain any provisions imposing additional financial burdens on the Contracting Authority (not provided for in Appendix No 9b to the SWZ), and the Contracting Authority (Attorney-in-Fact) will approve the final content of the Agreement.
