Opportunity description
The subject of this contract is the supply and repurchase of electricity for the needs of Ostrołęckie Przedsiębiorstwo Wodociągów i Kanalizacji Sp. z o.o. to the facilities listed in Annex No. 1 to the SWZ – description of the subject of the contract. The estimated electricity demand in the period from 01.01.2027 to 31.12.2027 is: 3570 MWh. 1. The subject of this contract is the supply and repurchase of electricity for the needs of Ostrołęckie Przedsiębiorstwo Wodociągów i Kanalizacji Sp. z o.o. to the facilities listed in Annex No. 1 to the SWZ – description of the subject of the contract. 2. The estimated electricity demand in the period from 01.01.2027 to 31.12.2027 is: 3570 MWh. 3. The Contracting Authority reserves the right to decrease or increase the total volume of electricity, relative to the quantity specified in point 2, by +/- 15% in relation to the total contract volume. Any change in the estimated consumption specified in paragraph 2 will not result in additional costs for the Contracting Authority, apart from settlement for the quantity of electricity actually consumed. 4. The estimated repurchase of electricity in the period from 01.01.2027 to 31.12.2027 is: 100 MWh (+/- 30%). 5. The Contracting Authority will conclude an agreement for the repurchase of energy generated from sources belonging to the Contracting Authority using the contract template proposed by the Contractor. The Contractor is obliged to prepare the agreement and adapt its provisions to the requirements of the SWZ. 6. Due to the impossibility of predicting, at the time of concluding the agreement, all circumstances affecting the number of facilities (consumption points) held by the Contracting Authority during the contract performance period, this number may be increased or decreased at the Contracting Authority’s request, separately within each tariff group, as enumerated respectively in Annex No. 1 to the SWZ and priced in the Tender Form. This change may not exceed 10% of the number of consumption points (but no fewer than 1 PPE) indicated in Annex No. 1 to the SWZ. (Article 455(1)(1) of the Pzp). 7. The Distribution System Operator in the Contracting Authority’s area of operation is PGE Dystrybucja S.A., Warsaw Branch. 8. The Contracting Authority has the status of a producer in a Small Renewable Energy Sources Installation – a biogas plant located at the wastewater treatment plant. The tariff under which the source is classified is B23, the source capacity is 514 kW, and the commissioning date is 15 June 2011. In 2027, the Contracting Authority will not use certificates of origin for energy. The source is connected to PPE No. 590543570301035743. 9. During the term of the agreement, the Contracting Authority will commission a photovoltaic installation with a capacity of 499 kW under tariff B23, connected to PPE No. 590543570301035743. 10. The Contracting Authority will have generation sources in the form of cogeneration using biogas from the wastewater treatment plant with a capacity of 514 kWe and a photovoltaic installation with a capacity of 499 kW; therefore, the Contractor must hold valid agreements and authorizations enabling the Contractor to perform the function of the entity responsible for commercial balancing for electricity sold under the Agreement in question. 11. The remaining conditions concerning performance of the contract are specified in the electricity sales agreement template – Annex No. 3 to the SWZ. 12. The subject of this contract is the supply of electricity whose quality parameters (Article 246(2) of the PZP) are specified, inter alia, in: a) the Distribution Network Operation and Maintenance Instructions prepared in accordance with Article 9g of the Energy Law Act; b) PN-EN 50160:2010 Voltage characteristics of electricity supplied by public distribution networks; c) Polish Standard PN-IEC 60038 IEC standard voltages. 13. The subject of the contract has not been divided into lots due to the uniform nature of the contract; at the same time, separate energy volumes have been distinguished depending on voltage and the method of its use: a) Tariff C11 – the estimated purchase of electricity during the contract period is 40.00 MWh. b) Tariff C12A – the estimated purchase of electricity during the contract period is 280.00 MWh. c) Tariff B23 – the estimated purchase of electricity during the contract period is 3250.00 MWh. The Contracting Authority obliges the Contractor to perform the activities arising from the power of attorney constituting Annex No. 3.1 to the draft agreement (Annex No. 3 to the SWZ), concerning the list of facilities constituting Annex No. 3.2 to the draft agreement (Annex No. 3 to the SWZ), in particular notifying the indicated Distribution System Operator for implementation of the electricity sales agreement concluded with the Contractor, submitting declarations of intent, and determining on behalf of the Contracting Authority all necessary information concerning termination of the electricity sales agreement currently in force and the provision of distribution services. 14. The Contracting Authority states that it has: a) separate energy sales agreements, valid until 31-12-2026 for Tariffs C11 and C12A – another change of supplier. Distribution agreements concluded for an indefinite period. b) separate agreements for tariff B23, with energy sales agreements concluded until 31-12-2026 – another change of supplier. Distribution agreements concluded for an indefinite period. c) The Contracting Authority has no promotional or loyalty agreements preventing sales from commencing on the indicated date. d) The Contracting Authority declares that the consumption points under tariff B23 have metering systems adapted to the TPA principle. e) The Contracting Authority declares that it holds the appropriate legal titles and the right to purchase electricity for the facilities indicated in the procedure. f) The selected Contractor will receive all detailed information concerning PPE held by the Contracting Authority and required to carry out the change of Supplier in an editable electronic version immediately after conclusion of the procedure. 15. The Contracting Authority reserves the possibility of changing the contract performance commencement date, but not to a date earlier than after the successful completion of the supplier switching process with the DSO.
