[numbering in accordance with the SWZ] The subject of the contract is the supply of electricity for the lighting of public spaces and public utility facilities of the City of Łódź and for the specified entities – participants of the Łódź Purchasing Group 2027. A detailed description of the subject of the contract is provided in Appendix No. 1 to the SWZ and in the model electricity supply agreement – Appendix No. 6 to the SWZ and in the model agreement – lump-sum agreement, Appendix No. 6a to the SWZ. Contract performance period: from the date of effective completion of the procedure for changing the supplier for individual PPEs, but no earlier than from 1 January 2027 until 31 December 2027. 22. REQUIREMENTS CONCERNING THE BID BOND, IF THE CONTRACTING AUTHORITY PROVIDES FOR THE OBLIGATION TO PAY A BID BOND 23.1. The Contracting Authority requires the Contractor to provide a bid bond in the amount of PLN 2,000,000.00 (in words: two million zlotys 00/100) 23.2. The bid bond shall be provided before the deadline for submission of tenders and maintained continuously until the expiry of the tender validity period, except in the cases referred to in Article 98(1)(2) and (3) and paragraph 2 of the Pzp Act. 1. Stanisław Moniuszko Complex of Music Schools in Łódź (a detailed list of entities is provided in Appendices No. 1a and 1b to the OPZ) 19.1 Following selection of the tender, each of the entities listed in point 1 of the SWZ, appearing on the Contracting Authority’s side, shall conclude a separate agreement with the Contractor. Numbering in accordance with the SWZ 4.1 The subject of the contract is the supply of electricity for the lighting of public spaces and public utility facilities of the City of Łódź and for the specified entities – participants of the Łódź Purchasing Group 2027. 4.2 A detailed description of the subject of the contract is provided in Appendix No. 1 to the SWZ and in the model electricity supply agreement – Appendix No. 6 to the SWZ and in the model agreement – lump-sum agreement, Appendix No. 6a to the SWZ. 39. FINAL INFORMATION 39.1 The Contracting Authority does not provide for: 39.1.1 conclusion of a framework agreement; 39.1.2 submission of variant and partial tenders; 39.1.3 settlements in foreign currencies; 39.1.4 an electronic auction; 39.1.5 reimbursement of the costs of participation in the procedure; 39.1.6. the possibility of awarding a contract consisting of the repetition of similar services pursuant to Article 214(1)(8) of the Pzp Act 39.1.7. a requirement or possibility to submit tenders in the form of electronic catalogs· or to attach electronic catalogs to the tender; 39.1.8. The Contractor carrying out a site visit or the Contractor inspecting documents necessary for performance of the contract that are available on-site at the Contracting Authority’s premises. 39.2 The Contracting Authority provides for an option right pursuant to Article 441 of the Pzp Act. During the term of the agreement, the Contracting Authority permits a change in the anticipated quantity of electricity subject to supply within the range of -10/+10% in the following circumstances: ➢ reduction in electricity consumption points; ➢ increase in electricity consumption points; ➢ change in demand for electricity 39.3 Before initiating the procedure, the Contracting Authority did not conduct preliminary market consultations. 39.4 Scope and conditions of amendments to the concluded agreement – matters relating to the agreement are regulated in the model electricity supply agreement – Appendix No. 6 to the SWZ and in the model agreement – lump-sum agreement, Appendix No. 6a to the SWZ 15. METHOD OF SUBMITTING TENDERS The tender comprises the following documents: 15.1 Tender form – prepared according to the template – Appendix No. 2 to the SWZ (signed with a qualified electronic signature); 15.2 Contractor’s declaration concerning grounds for exclusion under Article 5k of Regulation 833/2014, as amended by Regulation 2022/576, and Article 7(1) of the Act on special solutions concerning counteracting support for aggression against Ukraine and serving to protect national security, submitted pursuant to Article 125(1) of the Pzp Act, in accordance with the template constituting Appendix No. 5a to the SWZ (signed with a qualified electronic signature). In the case of contractors jointly applying for the contract, this declaration shall be submitted by each of those Contractors (this also applies to partners in a civil-law partnership). 15.3 Declaration of the Entity providing resources concerning grounds for exclusion under Article 5k of Regulation 833/2014, as amended by Regulation 2022/576, and Article 7(1) of the Act on special solutions concerning counteracting support for aggression against Ukraine and serving to protect national security, submitted pursuant to Article 125(5) of the Pzp Act, in accordance with the template constituting Appendix No. 5b to the SWZ (signed with a qualified electronic signature) – if applicable. 15.4 Power of attorney/powers of attorney for the person/persons signing the tender, if the tender is signed by an attorney-in-fact (if applicable). 15.5 Commitment of the entity providing its resources for the purposes of the Contractor submitting the tender (if applicable – draft commitment, Appendix No. 7 to the SWZ), or another entity-specific means of evidence confirming that, when performing the contract, the Contractor will have at its disposal the necessary resources of those entities (signed with a qualified electronic signature). 15.6 Proof of payment of the bid bond (in the case of a bid bond provided in the form of sureties or guarantees) 15.7 Declaration on the division of duties during performance of the contract (if applicable) – draft declaration, Appendix No. 9 to the SWZ.
