1. The procedure is conducted by the entity entrusted with conducting the procedure: WARSAW METROPOLITAN POLICE HEADQUARTERS. Address of the entity conducting the procedure: ul. The subject matter of the contract is the provision of domestic WAN link lease services, hereinafter referred to in the SWZ as the “service”. 3. A detailed description of the subject matter of the contract is provided in Annex No. 5 to the SWZ and Chapter XIX of the SWZ. 4. The Contracting Authority does not require subject-matter evidence to be submitted with the tender. 5. Employment requirements based on an employment relationship in the circumstances referred to in Article 95 of the Act: 1) The Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the following activities within the scope of contract performance: supervision of the proper functioning of the links. 2) During contract performance, the Contracting Authority is entitled to carry out inspections of the Contractor regarding compliance by the Contractor or Subcontractor with the requirement to employ, on the basis of an employment relationship, persons performing the activities specified in point 1. To verify compliance with these requirements, the Contracting Authority is entitled in particular to request: a) a statement from the employed worker, b) a statement from the contractor or subcontractor concerning the employment of the worker under an employment contract, c) a copy of the employed worker’s employment contract certified as a true copy of the original, d) other documents − containing information, including personal data, necessary to verify employment under an employment contract, in particular the employed worker’s first and last name, the date of conclusion of the employment contract, the type of employment contract and the scope of the worker’s duties; 3) At each request of the Contracting Authority, within the time limit specified in that request, the Contractor shall submit to the Contracting Authority the evidence indicated in point 2 in order to confirm compliance with the requirement that the Contractor or Subcontractor employ, on the basis of an employment relationship, persons performing the activities listed in point 1. The Contracting Authority specifies the sanctions for failure to comply with these requirements in Chapter XIX of the SWZ. 4) Where there are justified doubts as to compliance with labor law by the Contractor or Subcontractor, the Contracting Authority may request an inspection by the National Labour Inspectorate. 6. Information clause concerning the processing of personal data Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as “GDPR”, the Contracting Authority hereby informs you that: 1) the controller of your personal data is the Warsaw Metropolitan Police Commander; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Nowolipie 2, 00-150 Warsaw; email address: iod@ksp.policja.gov.pl 3) your personal data will be processed pursuant to Article 6(1)(c) GDPR for purposes connected with the public procurement procedure conducted under the open procedure for the Provision of domestic WAN link lease services, ref. No.: WZP-3872/25/258/Ł; 4) the recipients of your personal data will be persons or entities to whom the procedure documentation is made available pursuant to Article 18 and Article 74(1) of the Act; 5) your personal data will be stored, pursuant to Article 78 of the Act, for a period of 4 years from the date on which the public procurement procedure is completed, and if the term of the contract exceeds 4 years, the storage period shall cover the entire term of the contract; 6) the obligation to provide your personal data concerning you directly is a statutory requirement laid down in the provisions of the Act, connected with participation in the public procurement procedure; the consequences of failing to provide specific data arise from the Act; 7) decisions concerning your personal data will not be made by automated means, in accordance with Article 22 GDPR; 8) you have: a) pursuant to Article 15 GDPR, the right of access to your personal data; b) pursuant to Article 16 GDPR, the right to rectify your personal data*; c) pursuant to Article 18 GDPR, the right to request that the controller restrict the processing of personal data, subject to the cases referred to in Article 18(2) GDPR**; d) the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of your personal data infringes the provisions of GDPR; 9) you do not have: a) in connection with Article 17(3)(b), (d), or (e) GDPR, the right to erasure of personal data; b) the right to data portability referred to in Article 20 GDPR; c) pursuant to Article 21 GDPR, the right to object to the processing of personal data, because the legal basis for processing your personal data is Article 6(1)(b), (c), and (f) GDPR. *Explanation: exercising the right to rectification may not result in a change to the outcome of the public procurement procedure or a change to contractual provisions in a manner inconsistent with the Act, nor may it compromise the integrity of the record and its annexes. **Explanation: the right to restriction of processing does not apply to storage, for the purpose of ensuring the exercise of legal remedies or protecting the rights of another natural or legal person, or on grounds of important public interest of the European Union or a Member State. 7. Pursuant to Article 139 of the Act, the Contracting Authority provides for the reversed order of operations. 8. The Contracting Authority provides for cancellation of the procedure if the public funds that it intended to allocate to finance all or part of the contract have not been awarded. 1.
