A detailed description of the subject of the contract, including the minimum requirements concerning technical, functional, and performance parameters, equipment, compatibility, warranty, servicing, delivery, installation, commissioning, and training, is set out in Annex No. 1 to the SWZ – Description of the subject of the contract – required and evaluated parameters. The Contractor is required to specify in the OPZ Form the technical parameters of the device models offered and the values of the required parameters. The subject of the contract must be performed in accordance with the requirements specified in the OPZ and under the terms set out in the draft contractual provisions – Annex No. 4 to the SWZ. The Contractor is required to ensure the full compatibility of all offered components of the video system and their proper interoperability as part of a complete system, without the need for the Contracting Authority to make additional purchases or investments. >>>The Contracting Authority does not permit the submission of tenders for parts of the contract. The subject of the contract constitutes a functional, technical, and organizational whole, including in particular the delivery, assembly, installation, configuration, commissioning, and integration of all system components. Dividing the contract into parts could cause problems in ensuring the compatibility and proper functioning of individual components and make it difficult to determine unequivocally who is responsible for the operation of the entire system. Performance of the contract by a single contractor is justified on technical, organizational, and functional grounds. >>>Where the procurement documents indicate proprietary names, trademarks, manufacturers, models, sources, or origins, they must be understood as indicating a reference solution “or equivalent.” An equivalent solution must provide at least the same functionality, performance parameters, quality, safety, compatibility, and efficiency. A Contractor offering an equivalent solution is required to demonstrate its equivalence with appropriate documents. Failure to demonstrate equivalence will result in rejection of the tender pursuant to Article 226(1)(5) of the Pzp Act.
