The subject matter of the contract includes: a) obtaining the complete set of designs, opinions, decisions and approvals required by law and necessary to obtain a final and legally binding building permit decision in accordance with the Act of 7 July 1994 – Construction Law (Journal of Laws 2025, item 418) (acting on behalf of the Contracting Authority). b) The Contractor is required to provide author’s supervision in public procurement procedures for construction works and to provide answers to questions asked within 2 working days of the questions being submitted for preparation. c) providing Author’s Supervision throughout the entire period of the construction works, including monitoring the compliance of the work being carried out with the design documentation, applicable laws and standards, clarifying doubts concerning the construction and detailed designs and the solutions contained therein, and, where necessary, supplementing the details of the design documentation; agreeing with the Contracting Authority and the Construction Works Contractor on the possibility of introducing alternative solutions to those provided for in the design documentation with regard to materials and structures as well as technical and technological solutions, as proposed by the construction manager or the Investor’s Supervision Inspector. Implementation must be supervised so that the scope of the changes introduced does not cause a substantial change to the approved design, and participation in committees and technical meetings organised by the Contracting Authority is required. If necessary, the Designer will be required to be present at the construction site in order to verify the compliance of the construction works with the design solutions, provide appropriate advice and guidance to the Construction Works Contractor, and clarify on an ongoing basis any doubts and problems arising during the construction works. d) The Contractor undertakes to update the investor’s cost estimate free of charge for a period of 3 years from the date of its approval by the Contracting Authority (documentation acceptance report). e) the cost of obtaining the necessary permits and decisions shall be borne by the Contractor, and the Contracting Authority shall provide the necessary authorisations. 2) The design documentation should contain: a) construction, detailed and technical designs, prepared within the scope consistent with the Act of 7 July 1994 – Construction Law (Journal of Laws 2025, item 418, as amended) and the Regulation of the Minister of Infrastructure of 2 September 2004 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works, and the functional and utility programme (Journal of Laws 2021, item 2454), based on geological investigations and a water-law permit, as well as other approvals and permits, such as a decision on development conditions (if required), certificates from the Authority responsible for monitoring Natura 2000 areas, a declaration from the Authority responsible for water management, a decision establishing the conditions for carrying out the works, an environmental conditions decision, and a legally binding building permit. b) a bill of quantities containing a detailed list of the works planned for execution in the technological sequence of their performance, together with their detailed description and the calculation and listing of the quantities of the measurement units for the works, in accordance with the Regulation of the Minister of Infrastructure of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works, and the functional and utility programme (Journal of Laws of 2021, item 2454), c) Safety and Health Protection information (BiOZ), taking into account the conditions of the Regulation of the Minister of Infrastructure of 23 June 2003 on information concerning safety and health protection and the safety and health protection plan (Journal of Laws of 2003, No. 120, item 1126). d) technical specifications for the execution and acceptance of construction works (STWiOR), containing sets of requirements concerning the manner of performing construction works; covering in particular requirements regarding the properties of materials, the manner of execution and the assessment of the correctness of the performance of individual works. The STWiOR should specify the standard of equipment and materials affecting the price of the works, including construction site facilities and water and electricity supply points for site-facility and technological purposes, as well as arrangements concerning them with distributors for construction purposes, e) an investor’s cost estimate prepared in accordance with the arrangements specified in the Regulation of the Minister of Development and Technology of 20 December 2021 on determining the methods and bases for preparing an investor’s cost estimate, calculating the planned costs of design work and the planned costs of construction works specified in the functional and utility programme (Journal of Laws of 2021, item 2458,. f) a tender cost estimate (unpriced) for the purpose of conducting a public procurement procedure, g) a map showing the location of the facility in the 1992 coordinate system with the *.xml or *.shp extension for the purpose of placing the facility on the Digital Forest Map, h) the designs must comply with the content of the Project Implementation Manual “Guidelines for the implementation of small-scale retention and water erosion prevention tasks and facilities”, also available at www.ckps.lasy.gov.pl, which will be confirmed by an entry in the documentation handover report. 3). The Contractor undertakes to perform the Agreement within the following deadlines: 1) Stage I – 45 days from the date of conclusion of the agreement, i.e. by 28.09.2026; 2) Stage II – 10 months from the date of conclusion of the agreement, i.e. by 14.06.2027, 3) Stage III – from the commencement date of the construction works continuously until final acceptance and the obtaining of a legally binding occupancy permit decision, inclusive, but no later than 30 September 2028 (the indicated date is connected with the expiry of the deadline for settling the project co-financing agreement).
