The Contracting Authority entrusts, and the Contractor undertakes to perform: A service consisting in the preparation of design documentation for the modernization of two existing hospital buildings. The scope of the contract relates to two investment areas: a) Scope A.1 – Preparation of comprehensive multi-discipline design and cost-estimate documentation for the modernization, together with land development, of the hospital building at ul. Warszawska in Zgorzelec. Building with a usable floor area of approx. 2223m2 under the Project entitled “Support for the Mental Health Center for children and adolescents in Zgorzelec”, co-financed under measure FENX.06.01 “Healthcare system”, priority FENX.06 “Health” of the European Funds for Infrastructure, Climate, Environment Programme 2021-2027; Contract No.: FENX.06.01-IP.03-0022/24-00/498/2025/142 b) Scope A.2 – Preparation of comprehensive multi-discipline design and cost-estimate documentation for the reconstruction together with modernization, construction of an elevator and land development of the hospital building at ul. Rolnicza in Sieniawka. Building with a total usable floor area of approx. 1900 m2 under the Project entitled “Infrastructure support for psychiatric care for children and adolescents – III referral level at WS-SPZOZ in Zgorzelec”, co-financed under measure FENX.06.01 “Healthcare system”, priority FENX.06 “Health” of the European Funds for Infrastructure, Climate, Environment Programme 2021-2027. Contract No.: No. FENX.06.01-IP.03-0046/25-00/498/2025/504 Place of implementation of the investment: Scope A.1 – ul. Warszawska 30, 59-900 Zgorzelec Scope A.2 – ul. Rolnicza 25, 59-921 Sieniawka Place of performance of the contract: Multi-Specialist Hospital – Independent Public Healthcare Complex in Zgorzelec; 59-900 Zgorzelec, ul. Lubańska 11-12 3.3. The detailed scope of the work commissioned to the Contractor is specified in the draft contract (Appendix No. 8 to the SWZ) and Appendix No. 1.1 to the SWZ – Description of the subject matter of the contract (The Appendices to the Description of the Subject Matter of the Contract constitute baseline and informational data made available to Contractors to enable proper identification of the existing conditions, determination of the scope of the necessary design work, and due and precise estimation of the tender price. These appendices do not constitute a description of the Contracting Authority’s requirements regarding the designed material or technological solutions. The references contained therein to trademarks, manufacturers, specific products, solutions, standards, approvals, technical specifications or other references are for informational purposes only and do not constitute requirements of the Contracting Authority or a restriction on the Contractor’s ability to use other solutions compliant with the OPZ, applicable regulations and principles of technical knowledge. The Contractor is obliged to prepare the Documentation in accordance with the requirements of the OPZ and the Contract, including the rules specified therein concerning the use of equivalent solutions.) 3.4. The Contracting Authority requires, and the Contractor undertakes, to employ employees directly performing activities in the following scope: administrative and organizational activities during the performance of the contract, under an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code, taking into account the minimum remuneration for work determined pursuant to Art. 2(3-5) of the Act of 10 October 2002 on minimum remuneration for work, throughout the entire period of performance of the Contract. The same obligation applies to the Contractor’s Subcontractors and further Subcontractors. 3.5. The requirements under Art. 134(2)(14) of the PZP Act are described in the draft contract – constituting Appendix No. 8 to the SWZ 4. Time limit and method of performance of the contract: 4.1. The contract must be completed within: Scope A.1 – up to 3 months from the date of conclusion of the contract Scope A.2 – up to 4 months from the date of conclusion of the contract 4.2. Method of payment – has been described in detail in the draft contract – Appendix No. 8 to the SWZ. 5. Information on subject-matter evidence 5.1. In order to confirm that the offered subject matter of the contract meets the requirements specified by the Contracting Authority, Contractors are obliged to submit the following documents (the documents must be submitted together with the tender): the Contracting Authority does not require subject-matter evidence No. consistent with the SWZ: 10.1. General information. 10.1.1. Tenders, declarations referred to in Art. 125(1) of the PZP Act, entity-related evidence, including the declaration referred to in Art. 117(4) of the PZP Act and the undertaking of the entity making resources available referred to in Art. 118(3) of the PZP Act, and subject-matter evidence, shall be prepared in electronic form, in the data formats specified in the regulations issued pursuant to Art. 18 of the Act of 17 February 2005 on the computerization of the activities of entities performing public tasks (Journal of Laws of 2024, item 1557, consolidated text), taking into account the type of data transmitted. (data formats: .pdf, .doc, .docx, .rtf, .xps, .odt, .xls, .xlsx). 10.1.2. Information, declarations or documents other than those specified in point 10.1.1 of the SWZ, transmitted in the procedure, shall be prepared in electronic form in the data formats specified in the regulations issued pursuant to Art. 18 of the Act of 17 February 2005 on the computerization of the activities of entities performing public tasks or as text entered directly into a message transmitted using the electronic means of communication referred to below. 10.1.6. Electronic documents shall be transmitted in the procedure using the dedicated “openNexus” electronic Purchasing Platform https://platformazakupowa.pl/pn/spzoz_zgorzelec, hereinafter referred to as the Purchasing Platform, and the “Send a message to the Contracting Authority” form (the link to the Platform is indicated in point 1.1 of the SWZ). The date of transmission (receipt) of declarations, applications, notices and information shall be deemed to be the date on which they are sent via platformazakupowa.pl by clicking the “Send” button. The Contracting Authority also permits communication by e-mail at: zam.publ@spzoz.zgorzelec.pl (this does not apply to submission of the tender). In all correspondence related to this procedure, the Contracting Authority and Contractors shall use the case reference number – 31/ZP/2026. As a professional entity, the Contractor is obliged to check announcements and messages sent by the Contracting Authority directly on platformazakupowa.pl on the page of the relevant procedure, because the notification system may fail or a notification may be delivered to the SPAM folder 10.1.7. Where electronic documents in the procedure, transmitted using electronic means of communication, contain information constituting a trade secret within the meaning of the provisions of the Act of 16 April 1993 on combating unfair competition (consolidated text: Journal of Laws of 2026, item 85), the Contractor, in order to maintain the confidentiality of this information, shall transmit it in a separate and appropriately marked file. 10.1.12. Electronic documents in the procedure must jointly meet the following requirements: be recorded in a manner enabling them to be read, saved and reproduced multiple times, as well as transmitted using electronic means of communication or on an electronic data carrier; enable presentation of the content in electronic form, in particular by displaying that content on a screen monitor; enable presentation of the content in paper form, in particular by means of a printout; contain data in a layout leaving no doubt as to the content and context of the recorded information. 10.1.13. Electronic means of communication in the procedure used to receive electronic documents containing the declarations referred to in Art. 125(1) of the PZP Act, entity-related evidence, including the declaration referred to in Art. 117(4) of the PZP Act, and the undertaking of the entity making resources available, subject-matter evidence, power of attorney, and information, declarations or documents must enable identification of the entities transmitting these electronic documents and determination of the exact time and date of their receipt. FURTHER INFORMATION FROM POINT 10 CAN BE FOUND IN THE SWZ. 11 Requirements concerning the bid bond. 11.1 The Contracting Authority does not require a bid bond. 13.6. Contents of the tender. The submitted tender, bearing a qualified electronic signature, must contain: 13.6.1. completed Appendix No. 1 to the SWZ – Tender Form 13.6.2. completed Appendix No. 2 to the SWZ – European Single Procurement Document (ESPD). 13.6.3. completed Appendix No. 3 to the SWZ – declaration under Art. 5K of Regulation 833/2014 and Art. 7(1) of the Act on special solutions for counteracting support for aggression against Ukraine and serving to protect national security, 13.6.4. an extract or information from the National Court Register, Central Register and Information on Economic Activity or another appropriate register. The Contractor is not obliged to submit these documents if the Contracting Authority can obtain them using free and publicly accessible databases, provided that the Contractor indicates the data enabling access to these documents. The provisions of this point shall apply accordingly to a person acting on behalf of an entity making resources available under the rules specified in Art. 118 of the PZP Act or a subcontractor that is not an entity making resources available under such rules. 13.6.5. Completed Appendix No. 4 to the SWZ – undertaking of third-party entities (if applicable) 13.6.6. The Contractor shall submit together with the tender a detailed description of the offered equivalent subject matter of the contract, in which, for each product, it shall specify the manufacturer’s name, form/dose and other product characteristics enabling unambiguous identification of the offered product and confirmation of compliance with the description of the subject matter of the contract (in accordance with point 2.2 of the SWZ) – if applicable 13.6.7. powers of attorney – if necessary – see points 13.4.–13.6. of the SWZ. 17.5. Before conclusion of the contract, the Contracting Authority shall call upon the Contractor whose tender has been selected as the most advantageous to indicate: to provide the information necessary to complete the contract, including in particular to complete the data indicated in § 2(1) and 1.1). If the Contractor fails to submit the required information within the time limit set by the Contracting Authority, the Contracting Authority shall withdraw from concluding the contract with Procedure: open.
