The Contracting Authority entrusts, and the Contractor undertakes to perform: A service consisting in the development of an architectural concept, a multidisciplinary concept, a Functional and Utility Program, and WKI for the construction of a new hospital building together with a connecting passage and a landing site for air ambulance helicopters, as well as land development. A building with a usable floor area of approximately 3,400 m2, serving psychiatric care and addiction treatment functions under the investment program entitled “Improvement of the conditions for the provision of psychiatric care and addiction treatment at WS-SPZOZ in Zgorzelec”, co-financed from the Medical Fund; Agreement No.: DOI/FM/SIS/PSYCH/2026/498/45. Lubańska 11-12 3.3. The detailed scope of the work commissioned to the Contractor is specified in the draft agreement (Appendix No. 8 to the SWZ) and Appendix No. 1.1 to the SWZ – Description of the subject matter of the contract. 3.4. The Contracting Authority requires, and the Contractor undertakes, to employ employees directly performing activities in the following scope: administrative and organizational activities during the performance of the contract, under an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code, taking into account the minimum remuneration for work determined pursuant to Article 2(3)-(5) of the Act of 10 October 2002 on minimum remuneration for work, throughout the entire period of performance of the Agreement. The same obligation applies to the Contractor’s Subcontractors and further Subcontractors. 3.5. The requirements under Article 134(2)(14) of the PZP Act are described in the draft agreement – constituting Appendix No. 8 to the SWZ 4. Time limit and method of performance of the contract: 4.1. The contract must be performed within: 4 months from the date of conclusion of the agreement. 4.2. The method of payment – has been described in detail in the draft agreement – Appendix No. 8 to the SWZ. 5. Information on subject-matter evidence 5.1. In order to confirm that the offered subject matter of the contract meets the requirements specified by the Contracting Authority, Contractors are required to submit the following documents (the documents must be submitted together with the tender): the Contracting Authority does not require subject-matter evidence 10.1 General information. 10.1.1. Tenders, declarations referred to in Article 125(1) of the PZP Act, entity-related evidence, including the declaration referred to in Article 117(4) of the PZP Act and the undertaking of the entity making resources available referred to in Article 118(3) of the PZP Act, and subject-matter evidence, shall be prepared in electronic form, in the data formats specified in the regulations issued pursuant to Article 18 of the Act of 17 February 2005 on the computerization of the activities of entities performing public tasks (Journal of Laws of 2024, item 1557, consolidated text), taking into account the type of data transmitted. (data formats: .pdf, .doc, .docx, .rtf, .xps, .odt, .xls, .xlsx). 10.1.2. Information, declarations, or documents other than those specified in point 10.1.1 of the SWZ, transmitted in the procedure, shall be prepared in electronic form in the data formats specified in the regulations issued pursuant to Article 18 of the Act of 17 February 2005 on the computerization of the activities of entities performing public tasks, or as text entered directly into a message transmitted using the means of electronic communication referred to below. 10.1.6. Electronic documents shall be transmitted in the procedure using the dedicated “openNexus” electronic Procurement Platform https://platformazakupowa.pl/pn/spzoz_zgorzelec, hereinafter referred to as the Procurement Platform, and the “Send a message to the contracting authority” form (the link to the Platform is indicated in point 1.1 of the SWZ). The date of transmission (receipt) of declarations, applications, notices, and information shall be deemed to be the date on which they are sent via platformazakupowa.pl by clicking the “Send” button. The Contracting Authority also permits communication by email at: zam.publ@spzoz.zgorzelec.pl (this does not apply to the submission of a tender). In all correspondence related to this procedure, the Contracting Authority and Contractors shall use the case reference number – 30/ZP/2026. The Contractor, as a professional entity, is obliged to check announcements and messages sent by the Contracting Authority directly on platformazakupowa.pl on the page of the relevant procedure, because the notification system may fail or a notification may be delivered to the SPAM folder 10.1.7. Where electronic documents in the procedure, transmitted using means of electronic communication, contain information constituting a trade secret within the meaning of the provisions of the Act of 16 April 1993 on combating unfair competition (consolidated text, Journal of Laws of 2026, item 85), the Contractor, in order to maintain the confidentiality of such information, shall transmit it in a separate and appropriately marked file. 10.1.12 Electronic documents in the procedure must jointly meet the following requirements: be recorded in a manner allowing them to be read, saved, and reproduced multiple times, as well as transmitted using means of electronic communication or on a computer data carrier; enable the content to be presented in electronic form, in particular by displaying such content on a screen monitor; enable the content to be presented in paper form, in particular by means of a printout; contain data in a layout that leaves no doubt as to the content and context of the recorded information. 11.1 The Contracting Authority does not require a bid bond. No. in accordance with the SWZ:13.6.Contents of the tender. The submitted tender, bearing a qualified electronic signature, must contain: 13.6.1.completed Appendix No. 1 to the SWZ – Tender Form 13.6.2.completed Appendix No. 2 to the SWZ – European Single Procurement Document (ESPD). 13.6.3.completed Appendix No. 3 to the SWZ – declaration under Article 5k of Regulation 833/2014 and Article 7(1) of the Act on special solutions for counteracting support for aggression against Ukraine and protecting national security, 13.6.4.a copy of or information from the National Court Register, the Central Register and Information on Economic Activity, or another appropriate register. The Contractor is not required to submit these documents if the Contracting Authority can obtain them from free and publicly accessible databases, provided that the Contractor indicates the data enabling access to these documents. The provisions of this point shall apply accordingly to a person acting on behalf of an entity making resources available under the rules specified in Article 118 of the PZP Act or a subcontractor that is not an entity making resources available under such rules. 13.6.5.Completed Appendix No. 4 to the SWZ – undertaking of third-party entities (if applicable) 13.6.6. The Contractor shall submit together with the tender a detailed description of the offered equivalent subject matter of the contract, in which, for each product, it shall specify the manufacturer’s name, form/dose, and other product characteristics allowing the offered product to be unambiguously identified and its compliance with the description of the subject matter of the contract to be confirmed (in accordance with the wording of point 2.2 of the SWZ) – if applicable 13.6.7.powers of attorney – if necessary – see points 13.4.–13.5. of the SWZ. 17.5. Before conclusion of the agreement, the Contracting Authority shall request the Contractor whose tender has been selected as the most advantageous to indicate: to provide the information necessary to complete the agreement, including in particular to complete the data indicated in § 2(1) and 1.1) If the Contractor fails to submit the required information within the time limit specified by the Contracting Authority, the Contracting Authority shall withdraw from concluding the agreement due to the fault of the Contractor.
