Opportunity description

The subject of the contract is the optimization of the existing documentation prepared on the basis of the currently outdated version of the Construction Law Act, consisting in the preparation of optimized and updated design documentation together with obtaining all necessary decisions, arrangements and permits, in particular a building permit, for three separate investment tasks concerning the restoration of small retention facilities in the Oborniki Śląskie Forest District: Part No. 1 - Restoration of a water reservoir in the Jary Forest District - 13-19-1.1-01 (previously 13-19-1.1-04) (in MRN2: 13-19-1.1-07) Part No. 2 - Restoration of water reservoirs in the Osolin Forest District - 13-19-1.1-02 (previously 13-19-1.1-05) (in MRN2: 13-19-1.1-08) Part No. 3 - Restoration of water reservoirs in the Trzebnica Forest District - 13-19-1.1-03 (previously 13-19-1.1-06) (in MRN2: 13-19-1.1-09) The subject of the contract for each of the aforementioned Parts includes the performance of work under Stage I and Stage II: Stage I: preparation, based on the existing design documentation (prepared on the basis of the previous version of the Construction Law Act), in accordance with the requirements of the SWZ, together with obtaining all documents necessary to commence construction works, i.e.: arrangements, opinions, decisions, studies, certificates, declarations and permits required by regulations and the rules of the project entitled: “Comprehensive project for the adaptation of forests and forestry to climate change – small retention and prevention of water erosion in lowland areas - continuation” (MRN3), co-financed by European Funds under the European Funds for Climate and Environment Infrastructure Programme 2021-2027, together with obtaining a final building permit decision or confirmation from the relevant authority that there are no grounds for lodging an objection to the submitted notification of commencement of construction works not requiring a building permit for the entire material scope of the investment task for which the design documentation should be prepared – within 13 months from the date of conclusion of the contract for the given part of the contract, with the proviso that the natural inventory must be completed and the preliminary design concept presented within 30 days from the date of conclusion of the contract; (The optimization assumptions constitute Annex No. 11 to the SWZ) Stage II: providing author's supervision over the execution of construction works performed on the basis of the design documentation that is the subject of this contract – from the date of initiation of the public procurement procedure for the performance of construction works on the basis of the design documentation that is the subject of this contract, until a final occupancy permit is obtained, but no longer than until 31.12.2028, with the proviso that, due to the fact that the final date for the implementation of Stage II corresponds to the deadline before which expenses incurred by the Contracting Authority in connection with the performance of the contract may be deemed eligible in accordance with Agreement No. 150/2025/MRN3 of 26.06.2025 on cooperation in the implementation of the Project concerning co-financing in the implementation of the Project: “Comprehensive project for the adaptation of forests and forestry to climate change – small retention and prevention of water erosion in lowland areas - continuation” (MRN3), co-financed by European Funds under the European Funds for Climate and Environment Infrastructure Programme 2021-2027”, referred to in point 2.4 of the SWZ, in the event of an amendment to the agreement regarding the final date for the eligibility of expenses, the final date for the implementation of Stage II will be changed automatically. The above change will not constitute an amendment to the contract, will not require the conclusion of an annex to the contract, and the Contracting Authority will notify the Contractor of the change in the deadline immediately after the amendment of the agreement referred to in point 2.4 of the SWZ. The planned (indicative) deadline for the performance of construction works on the basis of the design documentation that is the subject of this contract is 8 months from the date of conclusion of the contract with the construction works contractor, but no longer than until 31.12.2028. The above-mentioned 8-month deadline for the performance of the works is indicative and depends on the final acceptance of the construction works.
