Opportunity description

1.The subject of the contract is the renovation of the sanitary and changing-room facilities on the first floor of the gymnasium building of Aleksandra Piłsudska Primary School No. 2 with Bilingual Departments in Suwałki at 126 T. Kościuszki Street.2.A detailed description of the subject of the contract is provided in the bill of quantities, room layout and photographic documentation constituting annexes to the SWZ.3.All works must be carried out in accordance with the technical documentation and the applicable technical conditions and regulations.4.Pursuant to Art. 101(4) of the Act, where the subject of the contract is described by means of standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority permits solutions equivalent to those described. Furthermore, it shall be assumed that all such references are accompanied by the words "or equivalent". Demonstrating the equivalence of the offered solution pursuant to Art. 101(5) of the Act and according to the rules specified therein is the responsibility of the Contractor; in such a case, the Contractor is required to prove, by attaching to the tender the appropriate subject-matter evidence referred to in Art. 104-107 of the Pzp Act, that the proposed solutions satisfy the requirements specified in the description of the subject of the contract to an equivalent degree.5.Where trademarks have been used in the design documentation or the technical specification for the execution and acceptance of works, this means that they are provided as examples and specify only the minimum expected quality parameters and the required standard. The Contractor may use equivalent materials or equipment, but with similar or better technical and quality parameters, the use of which will in no way adversely affect the proper functioning of the solutions adopted in the design documentation. A Contractor who uses equivalent equipment or materials will be required to demonstrate during performance of the contract that the materials and equipment used meet the requirements specified by the Contracting Authority.6.The use of a label in the design documentation means that the Contracting Authority accepts all labels confirming that the construction works, supplies or services concerned meet requirements equivalent to those of the label specified by the Contracting Authority. Where, for reasons beyond its control, the Contractor cannot obtain the label specified by the Contracting Authority or an equivalent label, the Contracting Authority shall, within a time limit set by it, accept other corresponding subject-matter evidence, in particular the manufacturer's documentation, provided that the Contractor proves that the construction works, supplies or services to be performed by it meet the requirements of the specified label or the specified requirements indicated by the Contracting Authority.7.The use in the design documentation of a requirement to possess a certificate issued by a conformity assessment body or a report on tests conducted by that body as evidence confirming compliance with the requirements or characteristics specified in the description of the subject of the contract, tender evaluation criteria or contract performance conditions means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The Contracting Authority also accepts other appropriate evidence, in particular the manufacturer's technical documentation, where the Contractor concerned does not have access to certificates or test reports, or the possibility of obtaining them within the relevant time limit, provided that this lack of access cannot be attributed to the Contractor concerned and provided that the Contractor concerned proves that the construction works, supplies or services performed by it meet the requirements or criteria specified in the description of the subject of the contract, tender evaluation criteria or requirements related to contract performance.8.If the description of the subject of the contract includes a provision resulting from KNR or KNNR indicating the need to use specific equipment with specific parameters during performance of the contract, the Contracting Authority permits the use of other equipment, provided that this ensures achievement of the assumed design parameters and does not create a risk that the works performed will be inconsistent with the technical documentation. 9.Where the description is made by means of standards, equivalent solutions are understood to mean solutions that ensure compliance with the minimum requirements specified in the standard at a level no worse than described in the relevant standards. In the case of standards referenced in the SWZ (unless specified in detail), these are understood to be current standards. In other cases (description of the subject of the contract by means of technical assessments, technical specifications and technical reference systems), a product, material or system with technical, functional and quality parameters no worse than those listed in the description of the subject of the contract is considered equivalent.10.The Contracting Authority informs that it is applying for co-financing from the Physical Culture Development Fund under the Medal-worthy Changing Room – 2026 edition program.11.The Contractor is required to produce and install an information board. The board must be produced in accordance with the Guidelines on fulfilling information obligations applicable to beneficiaries of programs co-financed from the state budget or from state special-purpose funds (available at: https://www.gov.pl/web/premier/promocja).12.The Contractor is required to agree the design and content of the board and its placement with the Contracting Authority.13.The Contracting Authority informs that, pursuant to Art. 257 of the Pzp Act, it may cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to financing all or part of the contract are not granted to it (due to the limitations of the notice, the full text is in the SWZ).
