Opportunity description

I. 1. The subject of the contract is environmental supervision in the field of active bat protection, necessary for the proper performance of the works carried out as part of the investment, i.e. without harm to bats. 2. Supervision will be conducted at 3 facilities: • Church of St. John the Baptist in Łącko; • Church of St. Andrew the Apostle in Słopnice Dolne; • Church of the Finding of the Holy Cross in Ochotnica Dolna. The task of the Supervision will be close cooperation with RDOŚ and the Contractor in determining details of the planned works that are important for bats and continuous monitoring of their progress at the three facilities with breeding colonies. Numerous site visits will be necessary, as well as ongoing communication with all parties, including the facility owners and the investor's supervision, and the provision of comments and opinions. After completion of the works, the task of the Supervision will be to issue an opinion on and accept them. 2. The Contracting Authority – pursuant to Article 95(1) of the Act – requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons assigned by the Contractor or subcontractor to perform activities consisting in the performance of work in the manner specified in Article 22 § 1 of the Act of 26 June 1974, the Labour Code. 3. Details of the scope of the subject of this contract are specified in Appendix No. 9 to the SWZ – Description of the Subject of the Contract (OPZ). II. The tender in the procedure shall be submitted, under pain of invalidity, in electronic form, i.e. in electronic form bearing a qualified electronic signature. III. 1. Documents submitted by the contractor together with the tender: 1) completed Tender Form (Appendix No. 1 to the SWZ); if the contractor wishes to receive additional points under the second tender evaluation criterion, it shall submit a list of the expert's additional experience 2) power of attorney or another document confirming authorization to represent the contractor – if the tender or the statements or documents attached thereto are signed by an attorney-in-fact. 3) power of attorney to represent all Contractors jointly applying for the award of the contract, or alternatively a cooperation agreement from which the power of attorney in question will arise. 4) ESPD (compliant with the instructions in Appendix No. 2 to the SWZ), valid as at the tender submission date, for the purpose of providing temporary confirmation that the Contractor is not subject to exclusion from the procedure pursuant to Article 108(1) and Article 109(1)(4) of the Pzp Act and meets the conditions for participation in the procedure specified in the SWZ. Where Contractors jointly apply for the contract, an ESPD shall be submitted by each of the Contractors jointly applying for the contract; 5) an ESPD concerning other entities on whose resources the Contractor relies, for the purpose of providing temporary confirmation, as appropriate as at the tender submission date, that there are no grounds for their exclusion pursuant to Article 108(1) and Article 109(1)(4) of the Pzp Act and that they meet the conditions for participation in the procedure specified in the SWZ, to the extent that the Contractor relies on their resources; 6) a statement by the Contractor, valid as at the tender submission date, for the purpose of confirming that the Contractor is not subject to exclusion from the procedure pursuant to Article 5k of Council Regulation (EU) 2025/2033 and Article 7(1) of the Act on special solutions for counteracting support for aggression against Ukraine and protecting national security, compliant with the template constituting Appendix No. 8 to the SWZ. Where Contractors jointly apply for the contract, the statement shall be submitted by each of the Contractors jointly applying for the contract; 7) a statement by another entity on whose resources the Contractor relies, submitted for the purpose of confirming, as at the tender submission date, that this entity is not subject to exclusion from the procedure pursuant to Article 5k of Council Regulation (EU) Regulation 2025/2033 and Article 7(1) of the Act on special solutions for counteracting support for aggression against Ukraine and protecting national security, compliant with the template constituting Appendix No. 8 to the SWZ; 8) where the Contractor relies on the capacities or situation of entities providing resources: evidence confirming that, in performing the contract, the Contractor will have at its disposal the necessary resources of other entities, which shall in particular constitute an undertaking by those entities to place the necessary resources at the Contractor's disposal for the purposes of performing the contract, or another entity-specific means of evidence confirming that, in performing the contracts, the contractor will have at its disposal the necessary resources of those entities. 9) a statement by Contractors jointly applying for the award of the contract indicating which supplies or services will be performed by the individual contractors, compliant with the template constituting Appendix No. 7 to the SWZ (if applicable); V.
